Statement of Claim
Claimant says:
"One of the items purchased was a Cornice Board at a cost of $2284.30 and 3 pillows at a cost $748.00. At Robb & Stuck they require 50% down and sign a contract to start the production and balance paid up before delivery. Since I did all transactions by email or text I couldn't authorize in person so I text YES I AUTHORIZE. They held this against me, that I knew what I was doing which I didn't. I thought the authorization was to start production or order my furniture which I did for my other purchases made.
I tried to plead with Matt Evans, Store Mgr. & Marybeth Grant, Corporate that I didn't choose the style that they made for me. We have been going back and forth with emails, requesting documents which they provided but not what I wanted. I asked to meet with the decorator the store provided but they wouldn't allow it, that was around May 8th. I wasn't happy with her selection choice with a dining room table which they held against me. I have been accused of being hard to please, being abused as a customer and without reason they hung up on me, they didn't. So now I'm stuck with something I don't like and at a loss of over $3000."

  • We have spoken to Mrs. Quinn on numerous occasion over the past several months regarding this window treatment. As stated previously I have taken the matter to the highest level in our company and the decision is final. The window treatment is not defective and it is a accurate representation of the sales order that Mrs. Quinn agreed to with a drawing attached.

  • First of all my decorator had not send me any texts or emails so they implied that I knew the style that was chosen for me. Everything that was text to me was after the cjrnuxe board was up. I signed off because they wanted a down payment that was needed to start production. I assumed I was picking out another design and not what was given to me in the end.
The person that was sent out was the person who made the cornice board and not a Robb & Stucky employee. I'm loosing a lot of money and he does'nt want to concede in giving me anything to make up for my loss. I just want a credit to compensate this loss. They have not heard me at all explaining all the text they sent me after the fact. I never heard from anyone until the balance was due upon delivery. I will continue to support any allegations that they impose on me.

Respondent's Counteroffer Hide
The claimant's settlement terms were rejected with the following explanation:
  • "This is a custom window treatment that the client is unhappy with. We are sorry but she agreed to a drawing via email and it was made after it was agreed and she paid. First she complained about the quality so we sent a workroom to inspect and they said nothing was wrong. Than she complained it didn't match what she wanted so we had a second designer go inspect compared to drawing and it matches. There is nothing more we can do and we have had this conversation many, many, many times. "
