Statement of Claim
Claimant says:
"I went to your introductory Tax lien Certificate seminar in November 2015. I didn't sign up for the classes at that time because I felt that the sales tactics were suspect and pushy. However, knowing that the classes in my area started December 5th I enrolled via phone on December 4th.
I went to the class the following day. It started okay, we spent about two hours discussing their Tax lien certificate program. The cost of the program was $597 which included three days of classes. Then the orators put that topic aside and started talking about credit and using other peoples money. They discussed how you could increase the credit lines on your personal credit cards. They even made it an assignment that during lunch you should call your credit card companies and see if you can get your credit lines increased. Where was this going?
After lunch, some people reported how they did with their credit card companies. Then the orators started talking about their flipping home programs for the next four hours. They really went into minutia, such as paint, tiles, curb appeal etc. There was no further discussion of the Tax Lien Program. On my way out from class that day I saw a pile of blank contracts for continued Real estate workshop programs ranging in price from $38,000 to 45,000. That was their goal...this was all a bait and switch scam. I was livid.
The next day before class, I made my feelings known to the seminar administrator that I wouldn't be attending any further classes. That I knew where they were going with this program and I wanted a refund. I informed her I was still under the three day Right of Rescission due to the fact I signed just two days ago. She said the computers were not activated as yet and signed a note that the refund should be started. All the other attendees, students, Pigeons weren't able to invoke this right because they signed up weeks ago.
Upon arrival at home, not feeling secure with the seminar administrators efforts, I wrote a letter invoking my Right of Rescission to the company. Sent Certified Mail that day (Dec 6)
Nevertheless the charge for $597 appeared on my credit card statement. I disputed it, In that there was no valid contract due to my Right of Rescission. The charge was removed from my account. Only to be replaced 45 days later with another charge for $597 from the same company. I disputed the charge again and was refunded $398. So basically I am out $199 for being an aware Pigeon. Hopefully, I will get this sum back and at the same time make people cautious or avoid doing business with this company."
