Statement of Claim
Claimant says:
"Verbal agreement void after discovery the facility doubled my income illegally to make me "afford" a used car
4 1/2 hours of deliberating with the sales at this facilty I bought a used car to get out of the place. I tried to take the car back the next day, due to threat of unemployment and was refused stating that the information was already processed, it had been less than 72 hours. The dealership stated if there were ANY issues I can return the care within 72 hours and recieve my vehicle back. Our verbal agreement was to trade in my vehicle for the new used one with money credited plus an additional amount for sign on. I did some research to find out why my payments were high and the credit union stated the car facility doubled my income so I could "afford" the car. I am stuck with a car payment I can't afford and can't fix the issue.

The claimant's settlement terms were rejected with the following explanation:
  • I disagree with the explanation / grounds provided

"We have a printed and signed credit application from Ms. Kibble with the income that she stated. Her signiture on this and all the paperwork match. She also had the opportunity to refuse signing the contract that has the payments listed on it when she purchased. If she would like, we would be happy to try and trade her out of the car. "

  • Mrs. Kibble shouldnt have walked off the lot with a new/used car if she knew she couldn't afford the payments. She cannot blame the dealership because she can't read, understand agreements, or is just plain dumb.
