Statement of Claim
Claimant says:
"In January of 2013, I paid Randy and his company $350.00 to submit my taxes for 2012. I was informed that they were reviewing my tax information but unable to file on time and had put in an extension. He never filed my taxes and in 2014, IRS cancelled a loan for taxes in 2009 which I was paying off monthly because taxes for 2012 had not been filed in 2012. Subsequently I asked Randy to send back all documents he had for my taxes and he emailed me 2 spreadsheets I had sent him for my records but he sent no other documents that were needed to file 2012 taxes. I believe he lost my file. In order to file 2012 taxes, I had to go to the IRS and ask them to give me their copies of all tax information needed to file. I took this information to another accountant and within an hour he files with the ITS and got my taxes submitted. I was then required to reinstate my installment plan that cost $50 and to wait and se what other fees were assessed from both the state and Federal Government for late filing. Once I had gotten my information returned, I contacted Randy many times asking for the $350 refund. He put me off for many weeks and then asked me for my credit card number. I gave him the number and he told me he had sent in a credit for the $350. The credit never appeared on my bank statement. I contacted Randy again, many times and his remarks made it apparent he had no intention of returning my $350. When I told him I was going to file with Small Claims Court he said OKAY. His lack of service, total disregard for the situation he put me in and lack of refunding my money is not acceptable. He should be paying me the $350 for services not rendered and all fees incurred because of his lack of follow through and lack of completing on taxes for 2012. HIs attitude is appalling and he thinks he is untouchable. I want my money refunded.

IN January 2013, I had contracted with him for an additional $500 to help me with a tax issue for 2010 and to act as my representative for this dispute. He said he would contact the IRS and get the issue venue changed to California and he had a good working relationship with the IRS in California and would represent me for this dispute. He gave my information to another person in his office who did not do the job Randy said he would do. The venue never was changed to California. The dispute was actually handled by a free tax aid agency which I had sent my documentation to. Joe, the Accounting Services representative sent the same information to the same agency and that was the extent of my representation. I thought Joe was to represent me and he did nothing but send on my documentation. They did not represent me as Randy had indicated they would and this $500 should be refunded as well. Joe was very difficult to work with, like to send emails and not talk personally with me, I asked Randy to change the contact person for this dispute and he said he like Joe and refused to help me. The result of their awful representation left me owing the government over $6000.00. They never personally represented me, just sent off my documentation to the free agency and did not talk directly with the IRS.
Both of these issues were very stressful and gave me a lot of anxiety. Randy's attitude and lack of follow through on both issues was unprofessional and he needs to return my investment since he did not give me the service I paid him for. He should not be allowed to treat clients this way."
