The claimant's settlement terms were rejected with the following explanation:

    "Mr. Kurt Grahammer had the new Amana system installed on September 20, 2007 by Chill Factor Inc. not Quality First Air Conditioning Inc. Chill Factor Inc. is no longer in business. On July 31, 2008, Mr Grahammer contacted us and explained that his a/c system was not cooling. We sent over a technician and determined there was a freon leak in his Amana indoor coil. On August 1, 2008, we honored the warranty from Chill Factor Inc. and installed a new coil at no charge! Then on October 11th, 2010 Mr. Grahammer contacted us and stated that his system was not cooling properly. We sent a technician to diagnose the problem. The technician had determined that the Amana indoor evaporater coil was leaking freon. We quoted Mr. Grahammer $650.00 for labor and freon and he agreed to the figure. We installed the new coil as per his request and Mr. Grahammer refused to pay us for what was agreed on, and not until we preceded to lien his property did he pay us! We just received payment from him January 13th 2011. 5 months later. As we stated to Mr. Grahammer, Quality first air conditioning Inc. did not manufacture the system, nor did we install it. However, we have incurred all the costs to maintain the system to date and can no longer warranty a third party system. We strongly recommended to Mr. Grahammer to contact the manufacturer and discuss his concerns and that they would probably allow him to purchase an extended warranty. "
