Statement of Claim
"We took a healthy dog in for grooming one morning and were given an injured dog back at the end of th day. We spent that night ( until 1 am) at the Emergency vet's facility and then took him in to our own vet a few days later as instructed. It has cost $832.27 thus far for that grooming after x-rays, blood work, medications, etc. It appears the dog was seriously injured while in the care of Poochies either through carelessness or negligence. His throat was seriously injured to the point where he could not bark but only made grunting noises. His abdomen was sensitive to the point where he was constantly licking his lips due to nausea (according to the vet). His back was also sensitive to the point that he would not allow the vet to touch it. It would appear he was choaked by the grooming restraint collar and may have been pushed or jumped from the grooming table thus injuring neck, abdomen and back. Poochies groomer and the owner claim no responsibility and refuse to provide information on insurance, etc. my dog is recovering but still under medication and not well."

The claimant's settlement terms were rejected with the following explanation:
  • I disagree with the explanation / grounds provided

    "We are sorry that Duffy was not feeling well. We assure you we took the absolute best care of Duffy and that absolutely no harm was done to him during the grooming process. We feel your information is vague and was reported a week later than the service took place, so we are not sure that if something did happen to Duffy, may not have happened at our facility. We have video of Duffy playing before and after he was groomed, so if he did get hurt it may have been from playing. He was having a blast with the other dogs. I am sorry to bring this up but you did sign a Liability Release Waiver that I am happy to get you a copy of if you need. Again we are sorry that Duffy was not feeling well and wish him a speedy recovery."

  • The facts are not vague.  I have the bills to support all claims.  Duffy spent the night of grooming at the emergency vet.  The bill from the second vet is after insulted by them.  We stopped at your facility to talk with the groomer but was told she was busy.  We asked to see the owner but were told she was out of town until the following week.  There is nothing vague about these facts!
