Statement of Claim
Claimant says:
"Purchased a used 2006 Dodge Ram from Performance Auto Sales (then Chancellor Motors), on 03/04/2013. At time of purchase I was told to make payments directly to Performance Auto/Chancellor Motors.

After making payments to Performance Auto/Chancellor Motors, I began receiving late payment notices from Gold Acceptance Automotive Financial Services informing me that payment has not been made and late fees would be charged. This has been a continuing occurence.

I then contacted Performance Auto/Chancellor Motors about this problem. Was told by Luis Linares (dearler) that he would take care of the problem. Since then I have received late notice fees every month even though payments were made ahead of time. I have receipts for all payments made to Performance Auto/Chancellor Motors. I am still receiving notices from Gold Acceptance for earlier late payment fees. Payments are now being made directly to Gold Acceptance.

At time of sale I was also informed that due to income status and disability status any deductible fees would be taken care of by Performance Auto. My co-signer, Allysa Storm was present and a witness. In addition Shelly Dowell was also present when I inquired about a mechanical issue. Luis again informed myself and Shelly not to worry about any deductibles that may arise.

The truck is now in for repairs and the insurance company is now demanding a $1000 deductible fee. Luis now states that he never made the "deductible" statement, even though I have 2 witnesses. I am now with transportation because of this.

This dealer has cause me much stress and continues to do so!"
