Claimant says:
"Photographer Paul Greene negotiated a deal with me to take four photos of me for $325. Mr. Greene took only three photos and stated that he'd take the fourth photo at a later date to be done outdoors at night. This occured in March 2012 and due to the weather he decided that it would be best when the temperature was warmer at night. I attempted to schedule an appointment with Mr. Greene on a few ocassions, but Mr. Greene was unvailable and very difficult to reach. Mr. Greene informed me recently that he was unaware that we agreed on taking a fourth photo for the negotiated price. Mr. Greene and I had a variety of contact after he had taken the first three photos in order to set up a date to take the fourth photo. However, he remained to be consistently difficult to reach and not respond to my calls, emails and texts"

  • When you negotiated your agreement for four pictures, did you put this in writing with the photographer? If you have any information or evidence to that, it will help your claim. It sounds like you have had contract before via several different methods (email, text, phone). Any information that you have that shows a fourth photo is due to you will help in your claim. However, in terms of your contract, you are owed a fourth photo if you can show that it was what you negotiated, but not for your time because you are owed what you contracted for.
