Statement of Claim
Claimant says:
"January 20, 2013 I hired Old World Concrete Design to put a epoxy finish on my garage floor.

I paid them the agreed price, $875.00 (EIGHT HUNDRED SEVENTY FIVE DOLLARS), with my personal check #3108 drawn on MC Bank and Trust. I was told on the phone and in person, in front of friends, that they had experience at this type of job and that the work carried a one year guarantee.

On or about October 30, 2012 I noticed that a small area was starting to peel off and left exposed concrete. I contacted the owner Anthony Stymest and we set a date for him to come see what was happening.

He failed to show up for our appointment.

Two weeks later, I was able to again reach him by phone and he apologized and told me that he was tied up on a large job but that he would get back to me shortly and see what needed to be done to make it right. I asked him if he wanted photos, he said it wasn't necessary.

Two weeks later I was again unable to contact him by phone even after leaving several voice and text messages.

Finally, I was able to contact him by calling from my office phone on December 20, 2013. He asked me to send photos to his cell phone and that he would get right on it as soon as he had a chance. I sent those photos at 11:40am CST the next day December 21, 2013.

Again, I tried with no success, to reach him.

February 9, 2014 I finally got him on the phone again and this time he denies any responsibility or liability for the product failure.

  • We service over 200 jobs a year with very few complaints/problems. Mr winski called me to look at his garage over a year ago because he had problems with some sort of crystallization/calcification on his concrete slab. He was interested in our epoxy system. I thoroughly explained to mr winski that this possibly would not resolve his problem and that I absolutely could not warranty this job. At the time he did not care he "just wanted something done". A year later he calls me with issues and I reminded him of the original issues he was having and that there was no warranty provided on this job. I did ask him to send photos and offered some technical advice. It was 2 black spots that appeared to be some sort of spill. It was a beige epoxy put right on top of the gray cement. I did consider refunding his money out of good faith but do not feel it is the right thing to do based on the circumstances. If I make an agreement I stick to it and my reputation proves it.

    Yes, in one area of my garage there was a small part of the garage floor that showed some crystallization. Mr. Stymest said that they do this type of work all the time and that abrading the surface with his machine and applying two coats of two part epoxy would seal the surface and fix the problem.

    IF he had expressed doubts that this would not work I would not have hired him. Why would I pay someone to do work that would not fix the problem?

    Had Mr. Stymest actually taken the time to inspect the area that is flaking off he would have seen that this is several feet away from the affected area.

    He said, twice, in the presence of my friend, that I had a one year warranty on labor and materials.

    I did not call him "a year later", it was not quite 9 months and well within the warranty period.

    When I first contacted him with my concerns he agreed to come and inspect the area in question. We set a date but he never showed up or even called to re-schedule.

    When I finally got him on the phone he explained that he was tied up on a big job, but would call and let me know when he could come.

    He never called.

    I tried several times to reach him over the next 3 months by phone, email, and text messages. He dodged my calls and did not respond too my email or text messages.

    I finally reached him on his cell phone by calling from a number that he did not recognize. He told me to send him a photograph, which I did.

    Again, efforts to reach him after sending the photos were futile.

    Had he taken the time to actually inspect the areas that were flaking off he would see that these are not a "spill". It is evidence that the product he applied failed to adhere to the surface in that area.

    Mr. Stymest has had other complaints filed with the BETTER BUSINESS BUREAU in Crowley, LA. last year:

    The common thread seems to be his lack of interest in resolving complaints or addressing customer concerns.

    And, by the way, it is a GRAY epoxy over gray concrete. Perhaps he has me confused with another customer complaint??
