Statement of Claim
Claimant says:
"I had my mortgage company (Saxon) on April of 2011, I asked if I could defer a payment and they said yes. In May they sold my loan to Ocwen. When I started making my payments in July everything was fine. Then in March of 2012 I made a payment and they returned it say I was in foreclosure. When I called to find out what happened they said that I was more than ninety days late. So they said I could do a modification, meanwhile they would not take any payments. Finally in October they said I was approved and to make my first payment on November first and to make sure to sign the papers and fax them right away. I never received my documents but I made my payment on time. When I called to say I hadn't received them they said they would get on it right on it but to make sure to make December payment. I went to make my payment and it was refused. I called on December second and all I got was a recording saying my was to be sold at auction December fourth. Now I have no option but lose my home."

  • Just to also follow up with the advice already given, foreclosures in Florida have to go through a court. A bank or mortgage company can’t just arbitrarily set a foreclosure sale date to sell your house without a judgment of foreclosure. Have you been served with court papers yet? If not, definitely call the Florida Foreclosure Aid number, and also try to meet with a HUD approved housing counselor as soon as possible. Bring the proof of your approved modification with you when you meet with them. If and when you are served for a foreclosure, Florida does have a court run mediation program for foreclosure cases that you should definitely take advantage of.

  • I don't know exactly how far your in the foreclosure process? I'm sure that you have some paper work by now of lenders intentions. The number for Florida Foreclosure Aid is 1(877) 217-0786 call and see if they can help. I do urge you to let them know exactly what you stated in your claim, what you have gone through and documents as well to support your claim.There are issue for concern and you not being able to negotiate with lenders that you can't talk to on the phone. If there is a office for lenders maybe you can do face to face contact. Hope this helps.
