Statement of Claim
  • 02-28-2011 — Went in to finance a vehicle w/2 month warranty. Later finding that the vheicle had no heat and radio having to return to the dealership later to make a report and was called back to sign more paperwork.
  • 03-18-2011 — Vehicle powered down on the high way.
  • 03-19-2011 — Reported inccident.
  • 03-22-2011 — Vehicle powered down again.
  • 03-28-2011 — went to dealership to discuss trading vehicles/ was rejected. I asked about getting a Nissan, but The dealer Mario claimed that i cannot finance another vehicle. I later found out that there was no problem financing and to call the them back while in the dealers office.
  • 03-31-2011 — Returned with a witness to request a vehicle trade again. I was told of vehicle recall. Dealer claimed he will take vehicle to dealership. Vehicle was kept by dealer and i was told to return on April 5th. I mentioned that I did not want the vehicle unless some form of paperwork was shown proving the vehicle was safe.
  • 04-05-2011 — Showed up at the dealership in the moring and was stalled until 5 in the evening. Dealer claimed there were 0 results on the vehicles diognistics. dealer told me to return the fallowing day for the paper work.
  • 04-06-2011 — Returned to dealership and dealer was not present, I stayed a majority of the day two doors down waiting for the dealer to be told paperwork was lost. But he had registration and tags for the vehicle. Also, the vehicle was kept because the radio was not working again. Dealer told me to return the fallowing day, I stated that I cannot keep missing work.
  • 04-07-2011 — I returned with witness to retrieve documented proof of vehicles safety. I again asked for the vehicle to be traded. The dealer claimed he would give me the Nissan, but the finance company said no. I then called the finance company on the phone and was told that it would be ok to finance another vehicle and that Mario the dealer has to work out a deal for me. I gave Mario the phone to speak to the representative himself and Mario claimed that he will Not trade vehicles because he will lose money. After the phone conversation, Mario went ballistic trying to convince me to keep the car, raising his voice in anger exploding stating "THATS IT!" using profanity saying that he wants nothing to do with me and called the car back without being fixed and said that he wants nothing to do with me. Offering $500 to leave and never come back. I refused because i lost that amount just by missing work. He bagan writing where he took the car and diagnostics and that he would not be fixing the radio because he was aggrovated and i had him sign the paper.
  • 04-08-2011 — I myself personally went to the Honda dealership and had a diagnostics done, they found the problem with the vehicles power and offered a solution. I was charged $109.49. Invoice states "If the cable loosens again willl need a Honda battery reinstalled". It was found that the cables connected to the battery were not the right size, and would slip off of the battery causing the vehicle to shut down.
