Claimant says:
"I have two complaints:

1) We had signed a contract on January 25, 2011, for kitchen laminate countertops to be purchased by him, and installed, and also installartion of a new sink and faucet which I purchased, at his suggestion. All of the work "to be completed in a substantial and workmanlike manner for the sum of $1,600 - $1,000 downpayment and $600 due upon completion.' I gave him a check in the amount of $1,000, dated 1/25/11.

I called him in May 2011, to ask when hw would be starting the work, as I had taken delivery of the new sink, etc. He promised that he would have the work done by mid-October 2011.

I called on October 31, 2011, and left a message asking when he would start the work. He called on November 1, 2011, and said that he would not be able to start the work till NEXT YEAR! I offered to cancel the contract and have him return my deposit. He said he had already purchased the formica and could not return my $1,000.

On November 30, 2011, after hearing nothing from Mr. Swinehart, I called him at 440-541-7407, at 3:55 p.m., and left a message that I'd like to pick up the product he supposedly had purchased the following Saturday, and left a call-back number for him to reach. He returned that call quite promptly and told me that he had taken the (custom-ordered) laminate back to Home Depot, since he figured I probably no longer wanted him to do the work. I then requested that he return my $1,000 - he said he couldn't at that time - I asked him to call and make arrangements to do so as soon as possible.

It is now March 13, 2012 - I have not heard a word from Mr. Swinehart."
