Statement of Claim
Claimant says:
"In May 2012 I purchased a Serta Mattress (Putnam-firm) from Mattress One at their Spring Hill Florida location....after a short time the mattress developed a sagging-depression....when I slept on the Mattress I would sink into the Mattress ....I would estimate two to four inches...when in the depression I could not roll out of it...I reported this to the store and they scheduled a company inspection (at a cost of $49.00) the Inspector noted the sagging and wrote it in his report (I HAVE A COPY OF THE REPORT)
the company lost the report and made a second inspection with the same results...the company is making unreasonable requests to validate my claim
NOTE:- I am 90 years old and have back problems and have lost numerous of sleep and discomfort My Dr recommended a firm mattress"

  • Mar 27, 2013, Mattress One (responding party) added:
  • The customer had an inspection on his mattress. The guidelines of the warranty state that there has to be an inch and a half or greater impression with any one lying mattress or pressure being apllied to the mattress. Mt arm mattress had a sag of less than an inch which is considered a body impression and not a craftmanship defect.

  • Mar 27, 2013, Claiming party added:
  • when I am lying on the mattress I sink into the sagging area at l,east four to six inches....I used a ruler with just slight pressure....it measured four inches...the saggingis so deep I cannot roll out of it...Your inspectgor remaarked
    that the mattress warranted replacement

  • Mar 28, 2013, Claiming party added:
  • the warranty clearly states saggaing or body impressions thaat measure 1 1/2 " or greater aand says nothing about pressure being applied....you have added that to the warranty i have supplied proof that the sagging is more than the 1 1/2 "

  • Mar 28, 2013, Mattress One (responding party) added:
  • Mr. has sent pictures that shows the mattres sagging when force is applied to the mattress. Mr arm has nor submitted pictures of the mattress showing that it is not sagging unless he forcefully presses on the mattress. His first submission has a weighted object which seem sto be some kind of ceramic turtle. He is also pressing down on this weighted object. I have explained more than once on how to show the impression so it is accurate and Mr. Arm has yet to provide that.

  • Mar 28, 2013, Claiming party added:
  • YOU HAVE NOT TOLD ME HOW TO SHOW YOU THAT THE MATTRESS IS SAGGING WITHOUT SHOWING LIGHT PRESSURE...THE WARRANTY i HAVE DOES NOT SPECIFY THAT i CANNOT APPLY SOME PRESSSURE TO SHOW THE SAGGING ...I AM 90 YEARS OLD AND THIS IS CAUSING ME UNDUE HAARDSHIP AND STRESS...PLEASE ADVISE WHAT YOU WANT TO VERIFY MY CLAIM......NORMAN ARM
