Statement of Claim
Claimant says:
"The Management at Little Embers Day school is very unprofessional. As i was working at this daycare i became ill on 02/29/16 so i went to the Emergency room. When the doctor diagnosed me with strep throat. I called my manager ( Ms.Bow) to deliver the message that i would not be at work on 02/29/16 .This upset Ms.Bow so she stated " I dont have time for this and hung up in my face". So i sent a Text message stating that i was only listening to what the doctor ordered. So she called back and apologized for her actions. However after i told her that i would have to miss work for 24 hours once the antibiotic was taking she hung up on me again and stated "i dont care". I have Text messages of her telling me i needed to return to work the next day 03/01/16. I was not able to pick up my prescription until 2:00pm on 02/29/16 . So i asked the Walgreens pharmacist what time will i be okay to return to work. She stated " if you take it now you should be okay to go to work around this same time tomorrow . Instead i was expected to be clocked in and ready to work at 7:30 am. Once Ms.Bow realized i was in my class room she asked if i could watch the infant room. Which was a lie, she lied to me to get me in the other room to talk to me. Which was the only way she could get me in a room because i was not comfortable with being alone with her by the way she spoke to me on the phone the day before when i was at the emergency room. She apologize AGAIN for the way she spoke to me and for her hanging up on me twice. Well the meeting was not helpful at all it was basically her yelling at me and stating she had alot going on thats why she kept telling me she " doesnt care, and dont have time for this". She then went to mention that i need to be more like them and come to work sick . she stated both her and another lady in the room work sick, and that there are two different people in life one who gets sick and go to work (her) and people who get sick and do nothing but lay at home (me). At this point i see that this conversation is not fixing any thing so i politely walked out to go back to my class room. And as i passed her she mentioned that " if you call out again sick you are fired ! which is very confusing to me considering this was my first time calling out sick. As i continued on my regular schedule Breakfast ,lunch, and snack was served by me. I highly did not want to touch the food but with 15 kids one women can not do all the work so i had to help the other teacher in the class with the food.I took my hour break on 3/1/16 which is not normal but that day i needed my whole break i was physically sick and tired of MS.Bow constantly yelling at me .Ms.Bow usually never give us breaks and if we do its only for 30 mins .But if you look at our pay stubs she takes a hour out of our check everyday for break. Even if you were not able to take the break and i work 9 plus hours. As im getting all the kids up after snack Ms. Bow enters my class room and yells at me to get off of the toy shelf that i was leaning up against so i got up. But Ms.Bow wasn't satisfied she continue to yell at me to respect her that she is my boss. At this point i am standing there in shock . What am i suppose to say to you telling me to get up ? When she asked me to stand up i immediately did as she asked but that was not enough for her i guess. So she called me in her office and i honestly feel me taking my whole break took the cake for her she fired me. she asked me to get my bag and leave. When i tried to speak with the owner of the daycare (Ms. Tammy) she told me" No and put her hands up as if she had nothing to do with what was going on. Before i left her office i asked may i ask why you are firing me neither one of the ladies said anything. Up to this day neither of the ladies haven't had a problem out of me . I am also a full time student and there was days i was late to class or couldn't attend due to the fact i stayed at the daycare to help if they were short handed .I always wondered why the daycare was lacking employees and now i see why, they work you to death and treat you very wrong."
