Statement of Claim
Claimant says:
"Lemnark filed a claim against me through the courts. Which will allow them a percentage of my pay check. However, they have been taking my entire paycheck every week. Because i had direct deposit which my employer required Lenmark had access to my bank account and took my entire pay check. That action on their part rendered me penniless. It is against the Law for any company to take ALL OF ANYONE'S SALARY. Therefore, I am filing a complaint against Lenmark for this type of illegal activities against me. I have been forced in bankrupt court due to Lenmark's actions. I have been unemployed for the past few years off and on, which made it difficult tp repay my bills. When I was working on a regular basis Lenmark was paid on a regular basis. My account with Lenmark was very good. Now that I am unable to pay my debt Lenmark is tring to destroy me.
Why must I suffer because of the state of our economy and our economic down fall that our society is experiencing. I have always worked hard to pay my bills, now I have fallen victim of a bill collector that have taken it upon themselves to deplete me of ALL of my income every week for over 2 months. Why, How, and Who allows this type of abuse to consumers? How much more must I suffer and no one even cares or take time to answer my cries for help. I am in real crisis now without income, not because I am not working but because a collector is allowerd to take ALL of my salary and not one ever look in my direction. How can this be happening in these days of computer and information moving at the speed of light?
I am a consumer, I pay my taxes, are you telling me that I am unimportant by not answering my request or are you telling me as a poor consumer who is just barely making a living that I do not matter? I am poor, but I deserve my salary just lke anyone else who work hard for ther salary. Please respond (NEED HELP) Sincerely William Oates"

  • Because there is a previous court action associated with this, you should immediately go back to the court. There should be some form of exemption claim or form that you can file with the court, asking the court to order the collector to leave you a certain amount in your bank account. If they have a court order that states they can take a portion of your wages, they should still be able to do that without attaching your entire bank account. Also, at the same time, you could ask the court if instead of the company being allowed to deduct from your paycheck or attach your entire bank account, you could have a weekly or monthly payment order instead. This at least would protect you from these types of issues.
