Statement of Claim
Claimant says:
"I called and canceled my acct with them on Oct 9th, 2010. I assumed that my account
#10092185817 was canceled. They did not cancel my acct, but have said, now, that they only cancel accts through the mail. I did not receive any information on this from them. Now, they won't honor my cancellation in 2010 or refund more than 2 months of payments to me.

I believe this is a blatent act of fooling the client, myself, into thinking I have canceled. There is no guarantee of my having gotten a form from them through the mail, or of my return, if received, which I did not, made it through the mail back to them.. I cannot prove my cancellation, even though I verbally called them to cancel in Oct, 2010.

I believe this is dishonest business practice and that I should be refunded a great portion of my payments, which I assumed had been discontinued.
The monthly charge has been $20.00 a month.

I am reporting them for fraud to deceive me.

  • I looked at terms of agreement for Legal Shield apparently they are a sub company of Pre-Paid Legal Services. I did not see cancellation policy of service for the customer. What I kept on seeing is that how Legal Sheild can cancel your account due to violation of there terms. I also did more research regarding recurring charges. Information that was given that there are loopholes for credit card allowing venders to still keep getting recurring payments. I would send them a certified letter that you have asked them via telephone and now through certified mail to cancel you account. If you are using a credit card as payment for service this certified letter can let the credit card company know that the vendor is ignoring your request of cancellation and they can deny transactions. If you are using a checking account then I would go into bank and ask for assistance in stopping charges. This could help resolve any more charges.

  • I couldn't find anything on their website about the cancellation process. However, most companies will send verification that you have cancelled their service by mail or email and would include confirmation number, etc. If you didn't receive anything of that sort, it should have been suspect at that point. I would recommend sending them something in writing along with keeping proof of when you sent it to them. If they still take the money from your account after sending them the cancellation in writing, I would try calling your bank and seeing if there is anything they can do to stop the payments.

  • I was unable to find the terms and conditions of member agreements after searching, however, unfortunately usually these sort of membership arrangements do require that cancellations be in writing. If you still have a copy of your original membership agreement, it would probably have a section stating that membership needs to be cancelled in writing. Going forward, to cancel the membership, you should put in writing your cancellation request, and send it certified mail (so you can prove delivery) to the company to cancel your membership.
