Statement of Claim
Claimant says:
"When I signed up for a year exercise service with KOKO FitClub I was not given a copy of the contract because they had to scan it and said they would print me out a copy of the contract. Later when I asked for a copy of the contract they said the printer was not working and they could not print me a copy. When I cancelled my contract the same story wasa given that I could not have a copy of the cancellation and the printer was not working. I was two days late cancelling my contract because I had surgery. The woman at the Plano office said she would see if she could get the $216.50 cancellation fee waived. She later called me and said the area supervison had waived the cancellation fee. The next month I received a charge of $216.50 on my Credit card. You cannot talk to anyone at KOKO except the staff at the individual exercise places, so I went into the exercise facility in Plano and of course there was a new guy there and he told me the corporate had changed and charged to fee and that Corporate was all about the money not service. The credit card company ruled in my favor and returned the money. I have not heard from KOKO since that time. This week I received a letter from the collection company that I owed $1,151.93. The collection agency told me that when the credit card refused the $216.50 they charged me for a full year becuase in their minds the cancellation was null and void."
