Statement of Claim
Claimant says:
"In January of this year I purchased clothes from K-Mart on Blackwood Clementon Rd. in Clementon,
N.J. 08021. The clothes were on a rack that had a sign of 60% off clothes. When I paid for the items I did not know for sure they rang up right so when I got home i checked the receipt and the price of
the clothes at 60% and fgound that they only gave me 50% off. I immediately called K-Mart to complain and was told that whatever price was in the computer was the proper discount price but for which did not match the signs posted for the clothes. I again went into the same K-Mart and
tried to purchase clothes of which were marked 70% off which should have come 2 total as follows:
2 Shirts marked $24.99 X 30%= $14.99; 1 Shirt marked $29.99 X 30% = $9.00; 1 Shirt marked
$12.99 X 30% = $3.90 and 1 rug at $17.99 = $45.88 and the price rang up at $49.90. I asked for a
manager and she said the prices are what the computer says they are and refused to sell me the items at the reduced price and said that I am wrong. This makes the 2nd time the store has defrauded me and since the prices marked in the computer are not consistent with the discounts listed at the the clothing racks they are defrauding all their costumers who I am sure are not checking their receipts. I want 10% of the $60.00 I spent in January and I want the items I tried to purchase today at the price I have stated above and I want K-Mart to notify all the people that they were overcharged and to reimburse all the customers and I want them to pay a heft fine for the fraud they have perpetrated on the public."
