Housing discrimination is very real, and I'm so sorry that you felt it happened to you. It is not nice to feel as if the neighbors are alerting a landlord about you. The KCHR will investigate your complaint and if Mr. Nicely cannot produce a rental agreement they will take action. If there have already been similar complaints, he will want to respond to you here.
Unfortunately I have to agree with other comments that what you say doesn't constitute proof.
I found a house I loved in Dunwoody, GA and my agent called the selling agent to say that there was an offer coming in. When we presented the offer, the selling agent told us that the owner had just accepted another offer. It doesn't make any sense not to look at all offers, so I wondered if my race was involved. However, it could just as easily have been that the other offer was all cash or made by a friend of the family. I don't know, so it wouldn't have been fair to allege discrimination when I don't know that that is what it was.
I'm very sorry to say this, but I think this is best left to the KCHR unless the agent is aware that there have already been other complaints.
According to your account you did not view the property with the agent, you just called about it. How would he even have known what race you are? And even if he could have guessed, can you prove that the property was not already rented as you were told? It can take a while to get around to changing voicemail, especially if an agent is busy.
I think that you already know this. If the Kentucky Commission on Human Rights finds in your favor, you will likely be able to get a settlement anyway. However, if Jeff Nicely has already provided them, or will provide them, with evidence of a signed rental agreement that shows that the property was in fact already rented (just as he told you) you will not be entitled to anything.
I would like to see his response, but many people will not respond (on the advice of their attorney) if a matter is already being investigated.
Good luck with finding a house to rent, it's not always easy.
