Statement of Claim
Claimant says:
"On 10/8/16, a representative called me and said he had a website where retired union members could go to get information to help them with their union retirement. He informed me that he had three geographical regions (i.e., San Diego, Orange County, Los Angeles) that where open and for $750 I would have the exclusive rights to these regions to advertise my tax preparation service on his website. I was told by the representative that J.A S Graphic Design would prepare an accounting / tax advertisement for me and upon my review and approval they would place the advertisement on his website. After a few days, I tried to contact representative by phone but he never answered his phone. Therefore, I check the web side and notice J.A S Graphics had posted an ad on the website without my review or approval. Upon further review of representative website, I noticed that there were other tax preparation and accounting companies ads in the same geographical areas that representative had said I would have exclusive rights to (he called them open areas namely San Diego, Orange County and Los angles regions) This contradicts representative statement to me that I would have exclusive right to advertise only my tax preparation service on representative website for the San Diego, Orange County and Los Angeles Regions. Therefore, since representative would not answer his phone I notified American Express to cancel the $750 charge because I did not receive what I contracted for. On October 20, 2015, J.A.S. Graphics sent me an email providing a picture of the website they had prepared for me and I explain the situation above via phone to them and told them I had never reviewed or authorized them to place the ad on representative's website per the contract and that I cancelled the contract (see attachment 1). I told J.A.S. Graphics via telephone that I had canceled the contract because representative did not return my phone calls and lied to me because he said I would have exclusive rights to post my tax reporting services in the San Diego, Orange County Los Angeles regions. I also told J.A.S. I had cancelled the contract and never approved the advertising they placed on representative website in accordance with the contract. In addition, J.A.S Graphics asked to review my google web site advertisement (see attachment 2). The ad prepared by J.A.S. (see attachment 3) would take 5 minutes to prepare and put on representative website and is similar to my google website ad (see attachment 2), therefore, is not worth the anywhere near the $750 they charged."
