Statement of Claim
Claimant says:
"I made a contract with Jacuzzi to put a walking-tub in our bathroom , gave them a check for $1.000.00 dollars, the cancelling date was Feb. 7th midnight, (I found out that they cashed it on the seventh), on the fourth day we received bad new from my husband's family from Puerto Rico that his only sister had a massive heart attack and passed away, his family is very poor and we had come up with money to pay for all the funeral, ambulance cost. We call the company that our situation prevented us from going on with the tub expense and couldn't afford it at this time, to please return out $1.000.00 dollars, they refused. Also this company engages with gimicks to fool us old people, first the cancelling form doesn't even give you much info to go ahead if you decide to cancel, obviously is to make it hard for us to do that. They also told us that the 40 gallon water heated tank wasn't enough but they would sell us a 50 gallon tank. In general they companies are cheating people because they tell you that everything will cost about 20.000.00 dollars then they go to 16.000 dollars. I found out they only buy those tubs for about $2.500 ?"

  • I'm very emotional due to the death in the family and when you said I have to ask the funeral home for a letter, that could be done however I know that my husband who is over there right now and he's already been diagnosed with alzheimer this will only make him even more upset. I will be making a complain with the State of California Licensing Board as well as the Better Business Bureau we are in a hardship at this point and cannot afford this expense now. I did broke down crying and hung up before I have a stroke because I felt my blood pressure going up that I could not believe I have to ask my husband who already is also very emotional for any kind of proof.

  • This is to update everyone that Jacuzzi has decided to keep my money, I ended up telling my husband that I did get the money back from them to avoid him getting very upset. For me to give them proof will take a while because the area where the relatives lives is an area that is very hard to even get hold of them. It should be enough that I put it in writing regarding my hardship financially. It appears that they think I did it so I can go with another walking bathtub company and that is a big lie, believe me when I tell you that I have received many phone calls from companies that are offering me not only a much cheaper price for a better tub and will replace the $1.000 dollars the Jacuzzi took from us. Unfortunately the dream of getting such a tub which we could use very badly due to our disabilities will not happen! We did spend a great deal of money helping our family. I'm not sorry we did that, but it left us in a hole. So my warning to anyone who buys from Jacuzzu to go somewhere else and I will continue to let everyone know just how they charge you way too much money for their product!!!!I'm doing a lot of research as to how this type of companies overcharge older people like us. As a matter of fact I have spoken to several who didn't want their names because they come to check up their tubs. They say the paid too much!

Message from Jacuzzi Walking Tubs: On 2/25/2013 at 5:00pm I called Ms. Rosa to discuss her claim. I explained that we would gladly refund her deposit and release her of the terms of the contract provided she supply some evidence of the described hardship and provide the Notice of Cancellation. She refused and hung up.

  • As with any "reputable" company a death in the family always falls in the category of refundable. Airlines, Hotels, and other companies will refund in situations as these. It's dispicable that this company that caters to the eldery/disabled with their specialized tubs doesn't really care for their welfare, but are seen as prey. I will make sure that I'll inform friends and family of how this company will respond. If they do not give this family their money back who apparantly are already going through a very difficult time at this stage, I will make sure they are blacklisted with all my contacts.
