Statement of Claim
Claimant says:
"I went to Hertrich Mazda on July 30, 2016 to look at a new car to replace my 2007 Jeep Liberty. I dealt with Tina, who had sold us another new car in May, 2015, with whom I was very satisfied. I test-drove 2 cars and we agreed I would take one home (a Mazda CX-3) to see if my wife (who is 4'8" tall) could see to drive the car. We agreed that I could bring the car back if she could not. I called Tina back late Saturday afternoon after we determined my wife could not see past the side-view mirrors. She called me back on Sunday, first to suggest she try driving with a pillow to allow her to see. I told her that was unsafe and unsatisfactory. Tina agreed we should return the car on Monday and to get our Jeep back.
On Monday morning, she called to tell me that the dealership had sold my Jeep. This had never been agreed to. My wife took the CX-3 back and dealt with Paul, a sales manager. He convinced my wife to switch to a Mazda-3 with an electric seat, which gave her satisfactory visibility. They also convinced her to finance the new car to help offset the difference in price between the CX-3 and Mazda-3. Originally, I planned to pay cash for the new car.
I was away on a business trip on Monday to Thursday, but returned to the dealership on Friday, August 6. I dealt with Art, a financing manager, who I told I was very unhappy with the way this transaction had taken place and was told "sorry about that". Furthermore, I told him that I wanted to lease the car for 3 years, 30,000 miles, and that financing the car to buy it was not going to happen. He determined a lease payment and I agreed to that. On Saturday, August 7, I signed the lease agreement. I did get credit for the originally-negotiated price for my Jeep as a downpayment. The dealership also agreed to make the first of the 36 payments at no charge. On August 7 I was asked to sign a Power of Attorney Form, which authorized Hertrich to sell the Jeep. I signed this form. I still hold the title to the Jeep."
