Statement of Claim
Claimant says:
"I took my 1995 ford exp. in to have the passenger side window replaced. it had been broken out by a person unknown, I had only liability ins on my auto. I had to save the money to have my glass replaced. While it was at the shop being repaired, my drivers side window was working fine. When I picked my auto up, I seen my drivers side window all the way down. I went in to the office to pay for the repair that had been done got my key, and went to my autommobile. I started my car went to roll my window up, and it would not go up. I went back into the office to ask them what had happened to the driverside window. no one knew. The man who worked on my auto, said the window was down when it was brought in. I am the one who took my car in, i never drive with my windows down. It was up when I left my auto at the shop, I told the man that. At any rate I ask him what was wrong with it, and how much would it cost to get it fixed, when it had not been broken when i left it. He said " It was the motorin the window, and it would cost, $150.00. I told him no way. I may have to pay $150.00 to get it fixed, but not to them. They broke it."

The claimant's settlement terms were rejected with the following explanation:
  • "Ms. Meadows is correct in the fact that I would not help her with this claim for free. We repaired the passenger door glass at a very reasonable price and we were paid for it. The vehicle (95 Ford Explorer-16 yrs old) was pulled in the shop for repairs and the driver side window was rolled down. We do this to keep from getting keys locked in the vehicles. This is done to every car or truck that is pulled in my shop. I'm sorry that the window does not work now but how is it my fault for just rolling it down? It's not. How am I to know how well it worked before the car was brought in?"
