Statement of Claim
Claimant says:
"I opened an account with the hand me down boutique in October of 2010. A thrift store that sells clothes for babys and kids. I went in and signed for the account and started counting out my items I was going to leave. At the time I went in you could leave 25 items per 30 days. I started to count out the items that I was going to leave. Then a women who I thought at the time was the owner said you don't have to count those out you can just leave your tote. I brought in a huge 30 gallon tote with me filled to the very top with summer,winter, and fall clothes from 0-3t. I said are you sure I can count the items out. She said no since you have it in the tote you can just leave it in the tote here and we can just take out the items as needed and add to your account. I said ok thinking that it would be ok. I check on my account in june of 2011 and was going to cash it out I called in and asked how much was on my account. I was told over the phone that there was 50 dollars in my account. I said ok and was going to come in and cash out what I had on the account. I came in and didn't have my account number so they couldn't give me the money because they needed a few hours to look up the account so I left my name and they were to look it up I was going out of town so I was going to check back when I got back in town. The following week I called in and was told that they needed to look it up so I would need to call back. I gave my name again and said I need the account number. I tryed calling one more time and still was told they didn't see my name anywhere they where going to have to look it up. I decided that maybe I needed to go in there and make sure they actually write my name down. I went in and I told the women that I have been trying to get my account number for sometime and I keep being told that they have to look it up. I also said that I brought in a large amount of stuff I said to her that I left it here and I was wanting to know if my stuff was all sold to so I can get my tote back also. I said to the women I think it was the owner that took the tote from me and she said no she isn't the owner because the women I was talking to was the owner. She said the girl that took the tote from me was her daughter they work together. I said well I just want to get my account number so I can cash out my account and I want my tote back she said ok well I don't see your name over here (which was just a bunch of little scrap papers they had wrote names down on) so she said she needed to look the account up. I thought since she was the owner I would finally get the account. I said ok I will leave my name again I said I am going to leave my number so you can call me when you find my account. This was in November when I left my name with her. I never reseaved a phone call from her. I called in January 18th 2012 I said I have been trying to get my account and I came in over a month ago and left my name and number to have someone call me back and I haven't heard anything. The women that was on the phone was the owner. She said well that is not our responsibility to call and let you know what that is. I said well I have been haveing alot of trouble trying to get my account number and I came and left my name again and left my number and asked you to call me when you had my account number because no one ever seems to look it up. She said well let me look for your name. She said I see your name here and it does have your number but there is no account number written on it. I said wow ok I said this was well over a month ago and I really need my acccount number she said well I can look it up but I am going to need a couple hours to find it so call back in an hour or two. I said fine. I called her back two hours later and said I was calling back to get my account number now. She said yes I have your account number and she gave me the number and told me there was $0 dollars on the account. I was shocked I asked her how that could be because when I first called back in june I was told there was alittle over 50 dollars in the account. She said well your account has been inactive for over a year and the account clears. I said how has it been inactive she said if you haven't pulled any money out or put more clothes on to the account the account clears. I was very upset I had been trying to get my account for months and was even told how much my account had on it in june and tryed to get it out. I also had more then 25 items and they where suppose to be adding items every 30 days to my account that would of keep my account active for alot longer than when i just signed up. So I didn't understand how when I brought them winter summer and fall clothes back in october the clothes that they put out in the summer didn't get added to my account in the summer also(that right there should of keep my account active because I had alot of clothes). I also don't understand how they can't see previous history at all she just said it clears after a year. I said then I want my tote back that is mine that I brought all that in to you in. She said I would't know where that is its been a year its probably long gone by now. I said what do you mean its long gone by now I said where would it of went its a big 30 gallon storage tote. I said you don't sell totes here so someone has it and I want it back. She said she would check with her daughter but she really don't think she would know where it would be. I told her fine I would be in the next day. I came in on january 19th and I got there after 330 when I got off work. I told her who I was and she said oh ya. I asked her if she had talk to her daughter and she said that she forgot to talk to her and she left at 3. I wanted to talk to her more about the situation and how it doesn't make sence that my account sat in active and she said well what is it that you had in your tote and I said there was all seasons of clothes I said that is how I don't understand that my account could of been inactive because there was winter and summer items and there was alot of items to be put out and you weren't going to put them out all at one time so how my account didn't have things added to it over the time my things where here I don't get. Then her telling me my things are long gone and no money to show for it. They got all my clothes and the tote and I have nothing out of this whole thing. It was never told to me that the account cancels out after a year, I tryed to get my account number numerious times to close out my account and keep being delayed and I would of had my money out and account closed in june if they would of gave me my account then and not just ignored my requests over and over again. I would of never left that many items with them if I wasn't told by the employee her daughter that it was ok to. I trusted them to add things to my account and not ignore me when wanting to get what was mine."
