Statement of Claim
Claimant says:
"called for free estimate/signed contract-with downpayment check of 791.50 due at templating per contract - called next day to cancel templating and put everything on hold until further notice-decided to enlarge kitchencounter and since this co .does not do cabinet work was going to hire a carpenter. a few days later my check of 791.50 was cashed by granite transformation. Nothing had been done on my behalf - templating was cancelled. When I called was told I had three days to cancel and that I had called and cancelled the job next day was totally ingnored - and since then my calls have been ignored and my money has not been refunded."

  • Customer actually paid the 25% down as required at the signing of the contract. An additional 25% is due at the time of the template. Customer did not call to cancel the contract the day after signing the contract. First contact after contract signing was initiated by company a week after contract signing and not first day after nor by claimant. In order to avoid confusion, contract requires a written notice of cancellation and such written notice has never been received. Costs have been incurred on behalf of this job (processing, ensuring inventory available, displacing other jobs on schedule, as well as direct costs). Claim seems unclear when claimant states her desire to enlarge cabinets was a reason for cancelling contract when company can install over new cabinets.

  • Monday 3/11/13 free estimate - checking phone record Thur 3/14/13 call to schedule templating for Fr 3/15/13 was cancelled and job put on hold until further notice/decided to have configuration of kitchen countertop changed and needed the help of a carpenter. Monday 3/18/13 my credit card check of $791.50 was presented and cleared. Called the next day thought this was an oversight - I said I had not hired anybody yet to do the carpenter work and thought we were clear on holding off on everything including cashing the check. Then was told that I had plenty of time to do what I decided to do since Granite Transformations was in the process of training people to install the countertops and it maybe sometime in June until they can work on my project -I told her under those circumstances cancel and I want my money back - and I was told she would call me back on that - I was never contacted again. I know in this short timeframe with people being trained nothing was done on my behalf - not even a phone call!!!!
