Statement of Claim
Claimant says:
"The master had my son try out for class and then encouraged me to join my son and try it out a few weeks later. He told us he would charge us a discounted monthly fee of $200 which would reduce after a year. He gave me a fee sign up document to sign and I did after I joined. He then said that he would need me to confirm charges on my account each time before charging the fee. So for the 2 months we were there, he would ask when the fee was due and I would give him a card to charge.
In addition to the above unsatisfactory service, finances and personal issues, and distance which I explained to him so we stopped on the 10/30 as our last day. I went by on 11/14 to return a belt and told the instructor once I can afford it, we will resume. He did not say anything and said see you then. However the next day a charge of $100 came through my account followed by another one of $100 on the 17th. I called the listed company and they told me they were collecting on behalf of the school. I told them we were no longer at the school and they said either way we have a contract.
I told them I did not sign a contract, and they said that what they have showed I signed a 3 year contract. I called the instructor and he said, yes I signed a contract. I asked him what contract? and he said the fee sign-up sheet was a 3 year contract. I asked him how it was a contract as he did not say this to me at the beginning and only said he would charge us $200 per month and if we stayed over a year, he would reduce it as an incentive for us. I told him if he had told me this was a 3 year contract I would not have signed up.
I told him there is no way I could afford it and that is why we quit. He said he had no control over it that once he sends them to billing there is nothing he can do and that I need to call the billing company, that he would send me the number to the billing company. He then text me a number to call with the name of the person to contact.
So I called the billing company and they said that to get out of the contract would cost me $6000. I said that was ridiculous, so I called the master and he agreed that it was too high an amount, so he said he would talk to the billing company and told me that they were only trying to scare me. That the work of the billing company is to make me pay by scaring me. I called the master the next day and days after, but each time my call went to voice mail. However when I called from a different number he would answer, meaning he had blocked my number on his phone.
I then called the billing company and asked them to fax me the copy of the document that they had. On the same day, I went the school and talk to the master. On talking to him he said insisted that he had no control over the school. I told him to call the school and talk to them as he was the owner of the school, he said that he did not have his phone on him. I asked him what it would take to get out of the so called contract and he said he would have to talk to the billing company and would let me know, so me and my son left. I then asked him for a copy of the document that I had signed, which he gave me. On looking at the document and comparing it to the one sent to me by the billing company, there was inconsistency and modification of dates.
5 minutes later, he text me saying for me to pay $600 in $200 monthly installments to void the contract.
A few minutes later the billing company called and the contact person I had been talking to, said that he had spoken to his manager at the billing company and he would charge my card $600 dollars. I told him I did not agree with this and that the contract was void since the master had added in dates that he did not disclose to me when I signed what he had explained as a fee sign-up sheet. The billing company contact said that maybe the master had added the information. I told him I would take the matter forward at which point he said that he had no idea why I was upset as it was the first time he had spoken to me. I told him he was lying as he had been calling me every other day together with some lady from the billing company demanding I pay or incur late fees. At this point he also added that he was in marketing and not customer service so I might be mistaking him for someone else. I then advised him that I would record the ongoing conversations as he was changing stories and lying. He then hung up and threatened to contact his lawyer and forward me to collections.
The billing company has continued to call me daily and sent me a letter stating I owe $6000 with $400 in arrears and late fees.
When I call the master he does not answer my calls and calls from my phone go to voicemail, while the billing company continues to call daily.
I contacted an attorney who stated what language should be on the contract as well as the irregularities being followed by the school and billing company to collect funds.
I will be looking into going to small claims court as I have been harassed enough. No parent should have to go through this and a stop should be put to this."
