Respondent's Counteroffer Hide
The claimant's settlement terms were rejected with the following explanation:
  • I disagree with the explanation / grounds provided

"In reference to the matter of a bridge and partial which Mr. King requested a 6 unit bridge and a lower partial. He only paid for a 6 unit bridge & made a payment towards the lower partial. The 6 unit bridge was delivered 1/10/11 and Mr. King was satisfied with the bridge until he went home and his wife said "she didn't like it." She said "his lips cover his teeth and you can't see his teeth that much." So the patient made an appointment to come back in (a month later) stating he wanted to redo the bridge. The bridge fit perfect. I told him I would try to send it back to the lab and see if they could do it or we may have to start all over again. He was ok with it, if we had to start over from the beginning with the lab. I explained to the patient we couldn't start permanent fixed dental work first then we could start the procedure on the removable dental work . Mr. King has received money back for his overpayment. Considering he stopped treatment in the middle of the procedure, normally we would not give anything back. However, because Mr. King is a good patient and regular coming patient we do not want to lose our patient. Therefore, we gave him back his overpayment of what was due to him. I sent back some extra. Mr. King has contacted the office several times during patient hours. I have received his messages and returned his phone calls."
