Statement of Claim
Claimant says:
"I bought my car in July and it's been back to their shop 4 times in less than a month. Now it has to have a transmission put in it. I have only had it for 5 weeks . It's been broken down more than I've been able to drive it."

  • This response is to comment on certain points brought out by Ms Harvey regarding her recent purchase of an auto from our dealership. She was correct in stipulating she purchased this vehicle in July and that it has been back to our facility 4 times. The first time she returned the vehicle, it had a broken swaybar end. This is a very unusual occurence as we have not seen this happen in 22 years in this business. It was a very clean break and appeared that something from the roadway may have flew up and and damaged this part. This just does not happen from normal wear and tear. However, since she only had the vehicle for a short period of time, we corrected this problem by calling a mechanic in on the weekend and replacing this part.

    The second time she talked to us about a problem with her car, she again called late one evening about closing time and said that the vehicle would not move. Again since our service technicians had already left for the day, I personally went to her location to see if I could assist her. The vehicle started fine and I preceded to drive it back to our facility. I called her and told her I would have our service personnel check it out the following day. Not being able to find any conclusive problems, nor being able to duplicate the problem, we serviced the transmission and returned vehicle to Ms Harvey. She was also reminded at this time, that since we didn't find an exact problem, that if the transmission did act up again that it was covered by the 6 month warranty that she got with the vehicle administered by Auto Protec Warranties.

    Ms Harvey returned a few days later with a minor transmission leak that was caused by a malfunctioning ratchet. This we also corrected on the spot. All of the above work was performed with our apology for the inconvience and at no charge to Ms Harvey

    Approximately one week later Ms Harvey returned again stating that her transmission was again acting up. She informed me that she had already taken her vehicle to her personal mechanic and that he had asertained that problem was not with the transmission, but vehicle just needed to go to GM dealership to be re-programed. I told her to let my technicians check her vehicle and if they agreed we would make arrangements to do this. However, after test driving and inspecting her vehicle, our staff determined that the transmission did need to be repaired or replaced. I informed Ms Harvey of this diagnosis, but that if she felt strongly about her mechanic's opinion she could take the vehicle to a GM dealership for re-programing of the computer. If this corrected the problem then First Choice Auto would pay for it. If it didn't correct the problem then she would have to be responsible for charges. If this did not fix the problem then she was going to still need the transmission repairs.

    After discussing this, she was in agreement that the best route to take was to contact the warranty company and have them get a replacement transmission to us.
    Therefore, it would be readily available to swap out and not have Ms Harvey without a vehicle for an extended period of time. At this time I contacted Vince Rizzo with Auto Protec and confirmed that this was the best approach to handle this replacement. He also responded that he would contact Ms Harvey and get a transmission on the way to our shop.

    After not hearing from the warranty company in a couple of days. I again called Mr Rizzo. He informed me that Ms Harvey had elected to let her mechanic do this work. This was fine with us as we put Auto Protec warranties on just about all the vehicles we sell. The warranty is with the warranty company (Auto Protec) and our customers are not obligated to have the work performed in our shop.

    In summary, this E-mail from Peopleclaim is the first that I knew that Ms Harvey was not happy. We have done all within our power to assist her in this situtation. To my knowledge,. she has only been without her vehicle for one night. If we would have followed the agreed upon plan her replacement transmission would already have been installed. From the above statement,( which can be verified by my staff and also Mr Rizzo). how can Ms Harvey state that she has got the "Run Around" or that her vehicle has been broken down more than she has driven it? We at First Choice Auto vaule our relationships with our customers and try our best to convey this to them by being concerned with any problems that they might incur. We feel that we have shown this concern to Ms Harvey.

  • Not only was the transmission messed up, there is other issues with my vehicle. It's been parked for two weeks,so I'm not a happy customer as I have stated everytime I had to take it back to the shop. I just want my truck fixed right!!

  • I rejected this claim and responded to it promptly. I believe that Ms Harvey was treated fairly and professionally. I still wish she would of approached us personally with her dis-satisfaction. I also don't understand her statement about "getting the run around". I feel with my response this bad rating should be eliminated from our record. We have sold hundred's of vehicles and this is the only complaint that I know of. But that is our goal . to have 100% satisfied customers.

  • i did approach the owner of the first choice about the issues i was having out of the envoy i purchased. i got the run around because i had asked if the envoy had ever been in an accident, and you personally told me "NO NEVER" then when i go to sell the vehicle i found out it had a salvaged title! so no im not happy with this car lot and the way they do business.

  • Honey, you ripped yourself off when you failed to utilized the warranty provided for you that came with the car and fixed/replace the transmission through the warranty company!! Stop blaming other people for your bad decisioin making and for taking bad advance from your "so called" mechanic that obviously is trying to make a buck off you. Sorry for being so harsh, but wake up. You have a mechanic trying to make money off you!!! You HAVE A WARRANTY ON YOUR CAR PROVIDED BY YOUR CAR DEALER THAT YOU PURCHASED YOUR VEHICLE FROM!!! How about utilizing that first and the people that are taking their personal time and bending over backwards to help you out vs. the guy wanting you to reach into your pocket book. Doesn't take a rocket scientist.
