Claimant says:
"ON 1/24/14, I WENT TO F&D SALES TO LOOK AT CARS. I WAS INTERESTED BUT NOT COMMITTED TO BUYING. I LOOKED AT A 2005 FORD FOCUS, AND ASKED FOR A TEST DRIVE ONLY BECAUSE I ASKED FOR IT. I GAVE THEM A $500.00 DEPOSIT AND STATED IN FRONT OF 3 WITNESSES RHAT IF I SAW SOMETHING CLOSER AS I LIVE IN SUFFOLK COUNTY A GREAT DISTANCE AWAY IN LINDENHURST THAT I WAS NOT COMMITTING TO ANYTHING AND IF I SAW SOMETHING CLOSER I WOULD DO THAT INSTEAD. I DID NOT HAVE A VEHICLE AT THAT TIME. AT THAT TIME MY WIFE WOUND UP IN A HOSPITAL FOR OVER A MONTH. I HAD TO LAY OUT OF POCKET EXPENSES FOR A WHEELCHAIR, WALKER AND SHOWER CHAIR. I HAD NOT HEARD FROM F&D SALES. THEY SAID THEY HAD TRIED TO CALL ME BUT HAD NO RECORD OF IT ON MY PHONE. I CALLED THE DEALERSHIP SEVERAL RIMES AND RECEIVED NO RESPONSE, WHEN I FINALLY SPOKE TO FRANK AT F&D, I REQUESTED ONLY $250.00 BACK. HE SAID HE WOULD TALK TO THE OTHER OWNER DINO AND GET BACK TO ME. TO THIS DAY I HAVE NOT RECEIVED ANY RESPONSE FROM THEM."

  • we talked to a few guys there and nobody got back to us. I know that he never called because we never received a call. we did call and spoke to frank about settling for half of the money we laid out. he never got back to us. I was not committing to anything.

    "HE SIGNED A RECEIPT STATING NO REFUND ON DEPOSIT, I HELD THE TRUCK HERE FOR A MONTH AND 2 WEEKS WE HAVE A MUTUAL FRIEND NAMED DANIEL O THAT WILL BE HAPPY TO WRITE A STATEMENT AS WELL. WE TRIED CONTACTING THOMAS NO RESPONSE TILL ALMOST 2 MONTHS LATER ."
