Statement of Claim
Claimant says:
"On Tuesday, 08/14/18 I received an email from Express Employment stating that they were conducting a job fair for listed work pertaining to what I was searching in my career field. It stated to call the number provided to schedule an appointment. I ammediately phoned and spoke with the Representative @ the location of 1848 E. Sherman Blvd. Muskegon, Mi 49444. Scheduled an appt. for the next buisness day of 08/15/18 @ 10:30 am. Went to my scheduled appt. arrived and filled out all required paperwork provided to me. The Recruiter there, Andria Dress went over all work related details with me and she clearly stated that my position with the company of Continental Management of File Processor would be Full-Time with Benefits and permanent position.

I clearly had her repeat what she just explained to me once more as I wanted to be sure of what she was explaining knowing that before she offered the position that I was looking for a company that I can grow with long term full-time. She repeatedly said to me, yes this is exactly what I just offered to you. I begin filling out all paperwork for the job, she then said to me to report Monday Morning 08/20/18 @ 8:30 am to 5:00 pm and to report to Roxanne Robeck.

Was not given any training as she stated to me directly that she was to busy with her work and that she was going to call another manager into the office there from location of Grnd Rapids, Mi to come there and to train me. Move ahead to Wednesday work day of 08/22/18 as I reported to work @ 8:30am for my work day around, 2:45 pm that afternoon I was working and Roxanne Robeck the Manager received a phone call and ask of me to walk over to a building and Casey Insley another there wanted to see me. So I stopped my work and walked over there to another vacant apartment and inside there was some Baker College Furniture and Casey was there she asked of me if I could help assist another person there in whom was hired through Express a mover to move the furniture living room suit from that unit to the next unit there for her.

I clearly stated to her that I am letting you know that my lover back has been giving me issues lately and she spoke to say well, try to and if you cannot then just to move the lighter stuff there like the cushions, pillows and lamp. I said, that's fine and felt oblegated to assist because orders from a manager so I helped as I tried to lift one end of the heavy sofa and the mover on the other end of the sofa I amediately had to set in down gently as I did use proper lifting techniques. I felt a strain and spoke to the mover (male) that I couldn't continue to help because of my condition he completely understood and said to me no problem I got it. so when we both finished with the move of the furniture as we walked back over to the leasing office he said to me, I was the only one whom showed up today for work. I said, oh my! I'm sorry. Back at the office I amediately explained to Casey and Roxanne whom both were there that I felt like I may have pulled a muscle. Casey said, go upstairs and sit at the desk there and relax a bit so I did and my pain wasn't improving I came and said, I need to fill out a work related injury report she said to me ok well, I'll have to have Express fax a form over for me provided for you to fill out and state what exactly happened in the mean time I get a phone call to my cell and it was Peggy from Express asking me to go to Occupational Health to be checked over provided by Expresss. She stated tat they were waiting for my arrival there.

I left work at 3:30pm to go and get checked by a Doctor there for Express. Doctor checked me over stated that I did have a strain in my Abdomen area and clearly stated that to me why was I moving furniture when my duties were File Processor? I explained, I was doing what I was told provided Manager request. I have a copy of Doctor discharged slip in my posession. for work restrictions. Reported back to work on Thursday 08/23/18 @ 8:30 am with Doctor slip to be handed to them there at OakHill Village and TownHomes to make a copy for them to have and to clearly to to them provided Doctors orders not to lift any furniture futhermore that my position is File Processor not Mover. Peggy at Express explained that to me as well. Workday ended @ 5:00pm went home and my cell phone rang as I was driving home I answered and it was, Andria Dress on the other end stating to me that, The girls at the Office ask of me not to return to work on Friday 08/24/18 that I was not doing any of my work? I was saying, whaaaa! Huh! could you please repeat that I was totally shocked and appalled by this. I just felt so like what the heck no reason at all as I was doing my assigned duties required of me.

On Friday 08/24/18 I stopped by the Express Office to drop off my work schedule in order to be paid. I arrived there at 10:30am the door was locked and lights were off there wasn't any buisness hours listed just a phone number so I amediatedly cleed the number provided and it rang a bit before someone answered and I spoke of that I was at the Office there trying to drop off my schedule and it seemed to be closed. They stated that they do not open until 1:00 pm on Fridays. I said, You need to display your buisness then and I said, ok I'll stop back by before 5 today! she said, who is this and I said, why does it matter who I am that I'll come back by later in the day and hung up! Stopped in at 4:30pm with my work schedule sheet to leave with them and Andria Dress walked up to the counter with a smurk on her face and I spoke and said to her I'd like a printed check please and she said no, you will have to wait until the payday of Friday next week. I said back, that I was not leaving until she gave me a printed check in my hands and she said, If you do not leave I will call the police.

So I said, thank you and I do not apprieciate the emotional abuse that you, and your company have caused me and that I will not recommend the Express at this location for anyone whom is looking for work furthermore. Thank you and have a great day!"

  • After reading Billie’s incoherent statement, it is clear why the management company where she was assigned to do temporary, catch up work wouldn’t want to have her return. Some people are impossible to work with and they don’t see it. That is why they are not able to keep a good job. Our goal is to find every good person that wants to work a permanent work family. When we are unable to verify someone’s employment or get any references, we use temporary positions to build a business relationship with them so we can be their reference.

    "At Express Employment Professionals, we do promote that we specialize in permanent, long term placement and link good people with good companies. As part of our career-pathing program; we will help people with little experience in an area or someone that doesn't have consistent, verifiable employment and references and offer them short term, fill in positions to gain experience and build a relationship with us. This helps us to determine if we are able to help that individual gain the long term opportunities they seek. In this instance, the management company where she was assigned, needed short term, catch up help to get their new location up and functional. As with any new project, there is some uncertainty that requires flexibility from people, but provides potential long term opportunities to those that are flexible, accommodating, and easy to work with. We wish this would've worked out for Billie but the management company felt they couldn't work with her because she wasn't following directions and wouldn't help answer phones and pitch in with the office work as needed. "
