Statement of Claim
Claimant says:
"I purchase a car from this guy Alex on Feb.1.2012 and returned it on Feb.2.2012. This guy is taken the advantage of me because I am paralyzed. He gave me paper work for 1999 mercedes and the car I drove home was a 1996. The car was suppose to be the 1996,but I never drove the car. The lady that drove it for me stated to me when we stop about 70 miles up the highway for gas that the engine light was on. So I call him and he was real angry at me for callin about the light. I took the car on home then I started looking at the paperwork and the papers were incorrect. The next morning I took the car to the DMV in Albemarle,NC. the lady on the inside advise me to take the car back because nothing was right. So since he had hung the phone up on me about the light and wouldn`t answer the phone I just took his 1996 car and 1999 papers back to him. So I new the way he was acting toward me on the Feb.1 not to go alone on his lot so I call the police to go with me. I gave him his car back and paper, his secretary gave me a paper staten that they would return my money of $4448.00 the next day but when I call him he said he didn`t know what I was talken about. His shop is about 160 miles from where I live in NC. I had a lawyer to call him and he told him that he would give me my money that all I had to do is call and give him my information on my card. So when I call him he don`t know what I am talking about and hangs the phone up. The lady name is Katie and the guy that did the paper work name is Michael Patrick. The owner that hangs the phone up is Alex Guzanov."

  • I am writing on behalf of Exclusive Motorcars in response to Michael Lilly's complaint. Mr. Lilly purchased a 1996 Mercedes-Benz E320 online from eBay Motors site which was listed by our company. He purchased item #270902014915 in the name of Jacqueline Colson, then called later to inform the salesman that he would pick it up and would complete paperwork in his name, Michael Lilly. Mr. Lilly came to our dealership and paid for the vehicle by credit card as well as signed an "AS-IS" agreement that is required for all used car purchases in SC. We are strictly a used car dealer so some of our cars do require minor repairs , but overall we carry high-end and quality used vehicles. Also we have been in business a very long time in Greenville and have customers of all races, physical abilities, tax brackets, nationalities, etc. and everyone is treated fairly and respectfully. By law, we were in no way required to take back the vehicle when Mr. Lilly returned the next day, but we could see that he was worried about the light that was illuminated on the dashboard. Mike Patrick offered to have our service manager take a look and repair it at our expense if necessary, but Mr. Lilly refused saying he just wanted to give the car back and get his money back. So Katie told him that we could put the money back on the credit card he used to purchase the car but he would not come inside to do that nor would he give Katie the card number and expiration date so that she could manually refund the purchase. We also spoke with Mr. Lilly on the phone multiple times and reiterated that we needed to have his credit card information to do a refund and he would not provide that to us. I assume Mr. Lilly called his credit card company and had the money put back because it was debited out of our account. We are charged fees every time we swipe a credit/debit card, which we were in this case, and they were not refunded to us. In addition to this, after we kindly agreed to take back the car, we then had to take it to clean-up and have it detailed in order to put it back in retail inventory. So we are sorry for any inconvenience to Mr. Lilly but this has been an expensive headache for both parties.

What Claimant Wants Hide
1. Compensation: For him treating me this way because I am paralyzed and hanging the phone up as through nothing never exited. I paid $4448.00 on my card and it on my bank statement. Mar 25, 2012 $4,448.00
2. Pay me for my time: For the way he treated me. He should be more than glad because I`m this way. I`m no bad person and I have nine daughter, if I had this much to give away it would be to them. My baby girl is a freshman at NC STATE and the car was for her. What is he thinking. I ask the Lord to forgive him but this is hard. Mar 25, 2012 $1.00
3. Pay me interest $462.97
