Statement of Claim
Claimant says:
"EasyRest delivered an adjustable bed to our home that my father, Richard Seelbach (U.S. Army veteran} decided not to keep and the company refuses to come and pick up the bed and refund a $200.00 deposit back to my father. He has made several phone calls to the company and they give him the run around and refuse to assist him in this matter. EasyRest adjustable bed company is being very disrespectful and refuse to resolve this matter."

The claimant's settlement terms were rejected with the following explanation:
  • I disagree with the explanation / grounds provided

    "Mr. Seelbach ordered his bed on August 22, 2016 and took delivery on August 26, 2016. At the time of delivery he had an Right of inspection which states the bed will be completely assembled and the consumer can decide if they want to keep it. Mr. Seelbach signed the delivery receipt sating his satisfaction. The contract also allowed Mr. Seelbach until midnight of August 29 for cancellation. Mr. Seelbach did not cancel his order and it was not until a call from his daughter on September 8 that any request for return was filed. To date there has been no reason given for the request for the beds return. Mr. Seelbach had ample time both before and after delivery to cancel his order and chose not to cancel. Easy Rest has refused to accept the beds return based on the terms of the contract Mr. Seelbach signed. Because the consumer does not receive the result they request does not mean the company is disrespectful. The terms of the contract have been honored by Easy Rest and we expect the consumer to do the same. If there is a mechanical malfunction with the merchandise Easy rest will respond."
