Claimant says:
"I worked for Double D in 2012 when a drunk driver collided with my diesel truck totaling my truck. I was not a fault and recieved $33,000.00 and rebuilt truck. Then I decided to retire and shortly after had my identity and bank account stolen loosing all my savings. Tried to just make it on SSI found i couldn't so decided to return back to work so went to Double D. Transportation and asked for my job back. Waited a about a month for an answer so went and told them they would not find anyone else with my experience, and the only reason you haven't hired me yet is because of my age. Was hired the next day. Worked for awhile was loaded going up Castro Valley hwy loaded with petal to the metal, floor boarded when 2 cars, 1 on the left and one on the right past me and started to come in front of me noticed they were going to hit each other separated then i saw a flash, another car past me on the right side, shot in front of me. I jammed the brakes on and didn't have time to push the clutch in killing the motor, so a tow truck was called, then went to yard. Tow truck driver knew me and was not charged. Next day delivered load and finished the day. Waited for dispatch and got none went in the office was told to unhook no longer needed. Asked why got no answer asked again no answer. The was told i was not fired but no longer needed and asked why finally got answer saying i was no longer working because i had 2 instances to close together, drunk totaling my truck and me having to call a tow truck to prevent an accident. They told me i was not fired and I asked if not fired why am I not working. I believe my age is why. because of their actions in the past and this. Age discrimination. I want my job back and to be paid for missed time working plus them fined.
