Statement of Claim
Claimant says:
"On Aug 15th I called Dell for Tech support for my computer. I explained the problem and I was told one of the techs would be able to fix the computer and the support would be available for 30 days. I was told the computer would have to be reloaded and I explained I did not have the windows operating system disc. He assured me that was not a problem and one would be sent out to me within two business days and I could call tech support and they would walk me through it. I agreed and paid for the one month for 138.00.

After two weeks of tying to get the windows operating disc or a credit which ever came first, knowing I only by law had 30 days, I gave up and called my bank where they issued a credit for 138.00 on my bank acount on Sept. 15, 2011

In Nov. of 2011, Dell had the bank reverse the charge because I did not cancel. I did try I was either told no supervisor was available or a hello? hello? I can't hear you was told to me even though I was saying I am here.

Dell STole my money, THey do not even have the correct sold to or address listed on their invoice.

If their phone calls are truely recorded I am happy to provide the numbers I called from and the tapes can be listened to."

  • 08-17-2011 — called dell to find out where windows disc was that was ordered on 8/15
  • 08-22-2011 — called to cancel service due to dell not sending windows, Dell assured me it was coming.
  • 08-24-2011 — called dell to cancel service, I was told no supervisor
  • 08-27-2011 — I called dell to cancel service after being on hold and transfered for 30+ minutes the last transfer said they had to hang up because they could not hear me.
  • 08-29-2011 — Notified bank regarding dispute
  • 09-15-2011 — Bank credit my bank account for 138.00
  • 11-01-2011 — bank charged back credit due to dell disputes did not cancel within 30 days
  • 11-15-2011 — disputed online to dell to please mail windows disc. gave them all the information they gave the bank. Including the wrong name and address listed on the invoice. Not sure of exact date but done in the later part of November.
  • 01-03-2012 — I called my bank again they said by law they can not do anything, I suggested to go to arbitation and to contact you.
