Statement of Claim
Claimant says:
"I helped David in January and February 2012 by paying the vet bills for his cat Peter. The total of the two bills came to $368.73. I charged this on my credit card. It had free interest for six months which will expire 8/21/12. He agreed to pay me back $62 a month for 6 months which would have resolved the bill with no interest added. I have had to pay two late fees of $25 because I have not had the money to pay the bill on time. So now I am asking for all of the above in addition to my time, aggravation and the cost of pursuing this matter."

  • As of 6/14/12, I was willing to accept payments but you have not proven to me you are willing to work with me. So now, 6/26/12 I am not willing to accept payments, I am asking for payment in full.

  • David's statement is untrue. His cat was very sick while they were here visiting me. So sick he would have died. He did not know what to do. He did not have the money at the time. I offered my help by using my credit card that had free interest for 6 mos. He went along with it and agreed to pay me back in monthly installments and even paid me one payment. To me that is admission right there that he owes me and had intention to pay me until I "moved on" with my life. Yes I did do some other things for him. This has nothing to do with that. Those are not the things I am wanting anything in return for. I just want the money he owes me for his cat's vet bill; which he agreed to pay. I also have a statement from him in a message on facebook admitting that he would pay. Once he found out I had started dating, he was upset. I asked if he planned to still pay his bill. He then stated on facebook.. I cant believe you think I would stiff you, now I know what kind of person you think I am... Okay, so what kind of person are you? You have admitted you owe it, you made me one payment, where's the rest? Based on this proof so far I have a very good case. I am trying to settle this without going to court. If I do there will be more costs involved, including your travel to Missouri to settle or I will win by default, then there will be a judgement against you.

  • I will accept $377.79. This includes the $295 left from the original bill because of the $75 you have already paid. It then includes the costs of pursuing this; the fees are listed above. I did remove the two $30 fees. This is a reduced amount from what I originally asked for.

  • I am not here to bicker online about how our friendship went. But since you dragged this into it I will address it here for everyone to see. I felt sorry for you. You were very depressed, crying all the time, had no friends... I just wanted to be your friend and show you that it wasn't the end of the world. That's why I was nice to you and did things for you. You accepted everything very gracefully. Including all the hospitality I offered while you and your cat stayed with us for over a month. In fact, you enjoyed yourself so much while you were here, you did not even want to leave. I listened to you vent, cry, and sent you inspirational things to help you stay positive. You DID want more out of our relationship... Thats why you got angry after I got a boyfriend and then you stopped sending me payments. You then also proceeded to harass me, calling me at all times of the night. Even after my boyfriend answered and told you to stop calling. Then you contacted my daughter during school hours. The only reason I have contacted you lately is to remind you that you owe me this money. Every time I get a bill, I call, have to leave a message, so I then also text to let you know. I have done this for the past 3 months, unsuccessfully. If I pursue this matter further, it will be in court. You will then have to show up here in Missouri at your own cost or I will win by default. This has already posted publicly on the internet.

The claimant's settlement terms were rejected with the following explanation:
  • "told her i didnt want her help with anything that i could do it on my owen knew things between us wouldnt work out didnt want her help she wouldnt take no for an answer was her way all the time thats what turned me from her i wouldnt do it her way she would get mad didnt want the help knew and told her she insisted to do things for me that i didnt want told he to do them for someone alse i didnt want she pushed and pushed i just had to tell he to leave me along still she bothers me i knew it was a mistake to get involved with her i told her time and time not to do things for me but she would do them anyway "
