Statement of Claim
Claimant says:
"Holes in parking lot, where top gravel has been stripped off. When I was leaving store, I had packages in my arms and did not see the hole, my foot hit the hole and I fell on the gravel elbow first, then hip leg and finally head. Two men witnessed this, helped me into store. It took 15 minutes for store manager to come out. I was only offered a band aide from pharmacy. Mike, ASM said he would check it out. Never offered to fill out report. Store Manager was there but never came out. I went to ER, have severe pain in elbow, arms, shoulders, etc. Don, Store Manger told me that the parking lot was due to be repaved soon and everything would be fine. I advised him that he should put a cone or something over the hole, he said that was a great idea, yet he has not done that as of yet (4 days later). Risk management won't assist in medical treatment and parking lot is still a danger to customers. I do not have health insurance and cannot receive further treatment."

  • 10-26-2009 — Left work at 5 PM, stopped at CVS to pick up item for my ex-sister in law and a few halloween toys for my sons
  • 10-26-2009 — 5:10, left store went out front door towards my car, felt ankle give way and realized I was falling down. Heard loud crunch as I hit ground.
  • 10-26-2009 — Two gentlemen came running up to me, asked me if I was okay, I was shaking badly. Men waited with me and tried to help me up. They took me back into store.
  • 10-26-2009 — Waited 15 minutes for manger. Two witnesses stayed with me and tried to keep my mind off pain. Finally ASM Mike came up. He said he would check area out and offered me a band aid from pharmacy. Never offered to take a report.
  • 10-26-2009 — Store clerk advised me to go to ER and said the Store Manager Don was sitting in back on his butt.
  • 10-26-2009 — Witnesses helped me to my car, gave me their numbers. I called store manager, told him I had to go to ER. He said that he would take report after 2 PM next day, not to go to store before then. I went to ER. Damaged elbow, contusions, etc. need further exams, CVS will not pay for exams, I have no health insurance.
  • 10-26-2009 — Went to store at 8 AM, hole was not roped off or covered with cone. On site mgr on duty could not believe report wasn't filed. Took information, pharmacist filled partial script until everything could be worked out. Went home, waited three days for Risk MGT to return my calls.
  • 10-26-2009 — Risk MGT will not pay for any treatment, all must be out of my pocket until I am better then they will review the case.
