Statement of Claim
Claimant says:
"On March 2 we went by the Cricket Wireless store in Belton Texas,to see if they had a IPHONE 6s plus in rose color. The assistant Manager Christina Mungia said they were out and said she could get the district Manager Jakey Chan to get one at the Round Rock apple store,she said they only had gold and that it might not have a box but it will have manufacturer warranty with Apple.The phone is for my daughter she said it was OK, so Christina said we would have to pay cash up front so we paid total 822.70 and we asked for a receipt and what she did was hand write a receipt because she said he was paying cash for it and he wanted the cash back.When they got the phone she called us the next day and said it was there so when we went to pick it up she said here's the phone and kept it in her hand the whole time and put it back in the box so we left in a hurry because my husband grandmother was in the Hospital and not going to make it much longer, so when it was time to get my daughter from school.We gave her the box she opened it and she looked at it and it wasn't gold it was black and my daughter noticed it already had dents around the phone so right away we went back to the store and told another employee what was going on she immediately said this isn't a new phone and I hate when they do this to our customers so she started texting the Manager Christina she said we had left the store and we damage the phone there's nothing they could do. I called the apple customer service and the lady(Kendra Church 1-866-254-8313ext.1113887) ran the serial number and she said the phone isn't under warranty and that the phone was purchased on October 29-2014. We attempted twice to get a refund,left our number so the District manager would contact us we have never received a call. They refused to give us a refund even with their 7 Day return policy in place. We have called police and a police report is on file.Tried reaching out to the manager to explain our investigation about the whole situation they are not contacting us at all and Cricket Wireless has a 7 day policy so now hopefully we can either get the phone we were wanting or our money back.We feel like everything was a fraud and that we were scammed by Cricket Wireless.We would like action to be taken against these lying employees that are working there."

    We apologize to Ms. Lopez for any inconvenience or poor service she felt she received. Cricket strives to provide excellent service and we regret when that high standard is not met.

    Our records indicate that Ms. Lopez has also filed a Better Business Buearu complaint and her concerns have now been resolved.
