Statement of Claim
Claimant says:
"Company: Cool-Aid, Inverness, FL State Lic# CAC1816026
I was contacted by this cpmpany during the second week of May 2011 and informed that they had taken over service from a company I had a contract with and that I was due a free service call. May 24, 2011, a company tecnician (Ronnie Pagano) arrived at our residence and upon inspection of our two year old unit informed me that we needed a new capacitor at the cost of $310.00. When I balked because our unit from SEARS was very new he informed me that they always put cheep parts in new units and that this capacitor could cause me problems. I agreed but told him I wanted the old capacitor. I subsequently agreed to a two year service plan at a cost of $189.00. I asked two more times for the old capicitor and the tecnician said he would retrieve it from his van. He drove off without giving me the old capicitor. The following morning, I called Cool-Aid and told them I wanted the old capicitor and two days later I received a call from Ronnie Pagano statimg he had cleaned out his van and no longer had the old capicitor. On May 27, we left Florida for a seven week trip across the united states. On July 16, while on vacation I called a cell number of the owner of Cool-Aid and started to explain my displeasure. He was abrupt but did say that he didn't want an unhappy customer and didn't care about the $300.00 but asked if I would call him back Monday because he was busy. On July 18, I called the owner's cell (Mike) and he stated he was very busy and he would get back to me. On August 11, I spoke with Mike (owner) and related he was overwhelmed with his business and opening a new business for his wife. He said he would look into my complaint. Between August 18 - September 15, we received no word from Mike so we called the company and spoke with Barbara. I told her I had a bid on replacing the capicitor and it was only $79.00, including the service call. I told her I didn't want to continue with my contract of $189.00 for two years and expected a modification to the $310.00 charge for installing a new capicitor. She told me that they would have to prorate the service contract. I did not agree with that as we had tried to resolve our differences the day following the companies service. On September 17, we sent a request letter to Cool-Aid to the attention of "Barbara", as requested. On November 3, 2011, we called and spoke to Barbara again and she said she remembered our letter and complaint and would get back to us. Our request for a solution would to be reimbused for our service contract of $189.00 and to receive a reduction of the overchage on the instalation of the capicitor.
