Statement of Claim
"April 13, 2016 I signed a contract with CAR MATCH USA that stipulated “Owner desires to contract with CAR MATCH USA as an agent to match the vehicle owner with an individual to assume the vehicle owners remaining payments on the above described vehicle.” The contract was a sub-lease of my current lease and it has not been upheld. I am disappointed because:

After placing a $300 deposit with CAR MATCH USA to locate a buyer for the lease, the deposit was never returned.

Furthermore on November 2016, the lessee failed to make a lease payment on the account, which was immediately reported to my credit bureaus. While the matter regarding the late payments was claimed to be resolved by Car Match USA, late payments are still outstanding on the account as of May 8 2017.

On May 7 2017 I received a collection agency bill dated May 1 2017 forwarded from the NYC Dept of Finance. It stipulated that there were 5 unpaid parking tickets on the vehicle, all beginning November 30,2016 and totaling $708.16

After receiving the collection agency bill, I ran a plate search on the NYC Dept of Finance to find the car, as of May 12,2017, has 73 outstanding violations, 8 of which had reached judgment violation with a total amount owed equaling $6,410.77

There are new tickets being added daily to the car, lessee's tickets outrageously range from illegally parking in front of fire hydrants to leaving car parked during street cleaning. 

I am disappointed that both CAR MATCH USA and the lessee failed to uphold the contract and have created emotional, mental and financial trauma for me. Despite my best efforts to get in contact with the executing attorney, all contact information has been listed as out of business or out of service.

  • After reviewing your rejection, I find no evidence that you have upheld your portion of the contract and find that you’ve breached it.
    · Communication was made to your direct phone as well as company emails, whether or not you or any of your employees answered that communication was entirely up to you.

    · The authorized driver on the account lives in NYC while driving Florida plates, any search through http://nycserv.nyc.gov/NYCServWeb/NYCSERVMain will garner results showing that the vehicle with Florida License Plate HDDN16 now has a total of 75 outstanding tickets totaling $6,831.74.

    · Furthermore due to CAR MATCH USA’s negligence and the Vehicle Users breach of contract, the vehicle was towed from his possession due to those outstanding tickets owed to the NYPD making it their property to recover any unpaid tickets. If the payment according to “the user of the vehicle will be made May 15th 2017” than the user will be making payments on a vehicle he had towed for his unpaid tickets.

    · With regards to the $300 deposit, you can discuss that with Mark and Monica, Mark advertised it and Monica confirmed it.

    · “Recovery of losses” refers to a portion of what is currently owed to Toyota.

The claimant's settlement terms were rejected with the following explanation:
  • I need more information

    "After reviewing Ms. Hakim's complaint, we find no evidence of outstanding parking violations or any communication from Ms. Hakim regarding same.

    The user is up to date on all car payments after reviewing Ms. Hakims account. There is a payment which was due three days ago, May 12th 2017, which the user of the vehicle claimed will be made May 15th 2017.

    We are unsure of what deposit Ms. Hakim is referring to. We initially charge a posting fee to post the vehicle on our website.

    We respectfully ask for more information concerning the “Recovery of Losses”.
    "
