Statement of Claim
Claimant says:
"On July 27th 2018 we setup an appointment with a salesman whose name was Jesse to look at a 2010 BMW 328i that was advertised on cargurus.com the add reads the vehicle was CARFAX certified, which showed no accidents reported, which is wrong the left front fender had been knocked off and still missing the fender well. On the 28th when we drove to the dealership their had just been a bad accident on the corner by the dealership, the only test drive we were able to get was down a gravel road couldn't really tell much about the car except it did run down the gravel road, when we got back to the dealership I walked around the car and noticed all the tires were different but I thought I was getting a good deal on the car what I didn't notice was one of the wheels was bent, we went ahead and made the deal on the car, I had asked them to replaced the missing foglight on the left side and they said they had it on order later Gaby told me it wasn't on order once again I thought I was getting a decent deal he said you can pick them up for 50.00 anywhere, so the service mgr came and got the keys and said he was going to put some fuel in it and check the fluids and rotate the tires, the low tire light was on when we test drove the car, so I waited for an hour for him to do this, he finally comes back say's ok the car is ready, first thing I noticed it still had the same tire on the left front and as I left the low tire light was still on at about 5 miles outside of Giddings the oil light came on,i stop there and the car was nearly two quarts low the tires were rated at 60psi their was less the 30psi in all 4 tires, so they did nothing that they said they did. Now as I am pulling into my driveway at home the check engine light comes on, I take the car to two different and have two estimates for repair from the BMW dealership the estimate is 7510.00 from another independent BMW repair shop the estimate was 4831.56

Here is one of the kickers I still had Captains buyer tag on the car and both shops thought I need an inspection cause there was no sticker on the car but I got one with the plates, both shops were shocked because there was no way the car would pass an inspection. 1, right rear tail light doesn't work 2. both low beams headlights are out 3. windshield wipers don't work 4. left rear wheel bent so my complaint is the dealership falsely advertised a Carfax inspected car and dummy up a fake inspection or some one just signed off on it, and took advantage of my good faith that they would stand behind it, on a side note Jesse did call me and offer to fix the oil leaks but when I asked the service mgr how he checked the oil he said I checked it on the dipstick, 2010 BMW 328i does not have a dipstick so I don't believe they have anybody capable to repair the car,"
