Statement of Claim
Claimant says:
"On 12/5/13 my husband Lawrence Authorlee and I took our 2003 Chevy pickup to Calvert's to have a electrical diagnostic done. We picked the vehicle up five minutes before close and was told it was a fuel pump assembly. We declined the work to be done and paid the Grand Total of $43.76. When we approached our vehicle we realized they could not have moved the truck to do the diagnostic. We took our vehicle to another auto place and told them the gas gauge shows the vehicle to be empty after filling up completely with gas. This was told to Calvert's as well. Auto Care Experts INC 1223 W. Truman Road Indep. MO 64050 (816) 252-1366 stated it was the instrument panel cluster. We had them do the repairs. On 12/13/13 the day we picked up our chevy we stopped by Calvert's and and requested our money back from the electrical diagnostic. Ben Rickner took a copy of our receipt and stated he would try to get our money back. Ben stated he would talk to J.P. (John Pummel). I'm not sure if Pummel is the correct spelling but his cell# is 913-631-9995. I spoke with John on 1/8/14 and told him of our situation and some type of customer service response would have been appreciated. I had the day off on 1/8/14 so I stopped by Calvert's and Mr. Pummel happened to be there also. When I show him my printout that requested the grand total due he said that was not an invoice. I told him there's someone skimming from the profits by taking money from customers and not giving invoices as a true receipt. He then said how do I know you paid with cash. I said if I didn't I'm sure the cops would have stopped us on the way home. Then he wanted to tell me that their store was taking a man to court for non payment of a vehicle inspection. After I talked with John Pummel, I felt I was talking to just to be talking with nothing being accomplished."

"Hello,

Are they saying they did a diagnosis on your vehicle without moving it? Do they by chance have a handheld OBD system or movable machine?

If they are stating you did not pay them and you know you did, who was this paid too? I have worked on vehicles for over 20 years and if they did a diagnosis on this vehicle then it would have shown the issue.

Honestly, if you didn't pay then why did they let you take the vehicle?

Here is the law in Missouri " In Missouri, state consumer laws prohibit unfair and deceptive practices in auto repair. Mechanics who mislead, deceive, or make misrepresentations to consumers may be subject to penalties under the Merchandising Practices Act found in Chapter 407 of the Missouri Revised Statutes."
