Claimant says:
"I purchased a 2001 Polaris 325 Magnum from Bristow's for $2000. Prior to sale we were told: Traded in by an elderly couple, this machine is in good shape, and we always go through these before putting them on the market. We noted a possible carb problem and were told to bring it back if needed "WE WANT TO MAKE IT RIGHT". There were no warranties or warranty disclaimer clauses checked on the sales contract. We have driven this ATV less than 24 miles since purchase. We have replaced the battery, replaced the regulator, the stator also needs replacing, and the rear drive shaft needed replacing all for total expense to us of another $700. We have had it back to Bristow's twice and they will do nothing-- telling me "IF I EXPECTED TO PURCHASE SUCH A MACHINE IN WORKING CONDITION, "I SHOULD HAVE PURCHASED A NEW ONE". Just learned that the reason for the drive shaft problems is that it has not been greased for a long time."

  • It seems from researching your issue that this dealership is licensed to be a Polaris dealership. Even though you purchased the ATV used, perhaps Polaris itself could assist you in this situation. The company itself may be interested in the potentially negative publicity associated with a company that is a licensed dealer. Because ATVs fall into an odd area of law (for example, lemon laws usually don’t apply), if it was represented to you that the vehicle was in good shape and proved to have these issues, they could be responsible for some form of misrepresentation. Otherwise, anything else I would have suggested (Attorney General’s Office, Department of Natural Resources) you have already done.

  • Pay for the repairs you cheating bastards. "If you wanted something that works you shoulda bought new" is about the worst customer service statement I think i've ever heard.
