Statement of Claim
Claimant says:
"I contacted Beckley's Camping Center to see if they would be interested in buying our motor home. I spoke to a Kelly. I told him what I had and he said he would offer us $16,000 unseen. I called back again to tell him we would bring it up so he could see it and was told he was on vacation. I spoke to a Charlie he said he had the info from Kelly so I said we would bring it up. We met with Charlie and another gentleman. They looked at the motor home and stated that it had water damage in the front over hang, I said I told you that it happened when we bought it in 2000 new. The dealer said that it was fixed. When I cleaned out the motor home I took out the things that were stored in the top bunk and everything was dry. I do not get in the top bunk often as I am 77 & my husband is 81. Charlie told us that he would give his book value, which was $7,000. My husband said to him would he give us $10,000. He said no, that the book value was what he quoted. I asked him why Kelly quoted me $16,000 if he knew what their book value was. I told him that I went online and NADA quoted Avg. retail $17,710. and low retail 14,695. He stated that they don't go by that, they go by their book, which is yellow, and he had that book with him. I should have asked to let me see it but I took his word for it.
By this time my husband was getting upset. He has COPD and uses oxygen at night with a By Pap. He asked me what I wanted to do and I said it was up to him. Charlie told that we either take what he was offering or take the motor home back home. My husband was not in any condition to drive the motor home back to Linthicum, MD. which is about 1 hr and a half drive. Under duress we took what they offered. I feel that they ripped us off. I knew when we got home that we had made a big mistake so I contacted a FOP lawyer and sated my case. He told me unless we wanted to spend a lot of money in court we did have a leg to stand on. unfortunately I went on line and saw that they had listed our motor home for $29,995. I became furious and called Beckley's and asked to speak to Charlie and was told he was at lunch so I asked to speak to the manager. Kelly answered the phone and I told him that I saw our motor home listed for $29,995 and how come we only got $7,000 for it. He said they can list for what ever amount they choose. I told them that misrepresented himself by quoting one price and giving us such a low amount. I told him that I thought that Charlie took advantage of us because that we were upset. I know now that we should never taken the check, but it is too late, but it is not too late to report them so that maybe this will not happen to someone else. Kelly also stated that Charlie did not tell us that the motor home was just worth the $7,000. I said well where do think I got the figure from and the check in that amount if I was told that by Charlie. He said it was my word against his. I said I knew that and he was not dealing with a stupid old person which you thought you were and ended the phone call."

Message from Beckley's Camping Center: This purchase was totally unsolicited by Beckleys Camping Center. In both the orginal and 2nd phone calls concerning the Winnebago that Mr and Mrs Dietz asked us to purchase, the model and condition were both misrepresented to us. Once we inspected the unit, we found outside wall delamination and water leak issues with the unit as well as it was not the model represented to us on the phone. I advised Mr and Mrs Dietz that I really was not interesed in making them and offer. They asked me to make them an offer anyway. I reluctantly offered to purchase the unit for $7,000. Mr and Mrs Dietz accepted our offer of $7,000. We put asking prices on our units at our descretion, expecting that we will have to deal and negotate price, thus the title "dealer". Asking prices are simply that; asking prices, and in no way are an indication of what we will sell a unit for after all negotations including any repairs and/or warranties are discussed. It is unfortunate that Mr and Mrs Dietz feels "ripped off", when in fact they pursued us to purchase the unit, misrepresented it to us on the phone, accepted our reluctant offer to purchase the unit, and then got upset when they saw the asking price we posted not knowing how we would ultimateley have to sell the unit.
