Statement of Claim
Claimant says:
"I was going through the modification process and was told by my primary point of contact that I needed to refax my profit n loss statement because it did not have my wife's signature. I faxed that doc. before the deadline and one week later they told me in a letter that I missed the deadline. I checked my dates and realized that I did not miss the deadline. By then BOA had transferred my loan to another servicer and after further and further calling that servicer which is Green Tree, they proceeded to sell my home in an auction on January 9, 2013. Still in my home but seeking to keep it through a loan mod. for my family."

  • Did they sell your home at auction through a court ordered sale, or did you have a provision in your original mortgage that allowed them to bypass the court process? If there was a court case associated with your mortgage foreclosure, you should go to the court to see if you have any rights to potentially reopen your case because you weren’t aware of the possible auction. If there was an auction, were you notified prior to the auction actually taking place? If you were not, then the auction may not be valid. If the auction was valid as part of a power-of-sale clause in your mortgage documents (which does not require a court case to be filed), and you were notified prior to the auction, unfortunately a modification at this point may not be possible. You should also contact a HUD approved housing counselor to see if you have any options available to you.
