Respondent's Counteroffer Hide
The claimant's settlement terms were rejected with the following explanation:
  • I disagree with the explanation / grounds provided

"we did an oil change on this vehicle as described by the owner. We did nothing that would make the car shut off. and we did not destroy her engine. Her claims that we owe her an engine is not applicable to this situation because she would not have been able to drive such a distance to and from work if the oil change was done improperly. we are not an oil change facility, as such we do not have uncertified people touching cars. We are a full service repair facility, as such the people doing the oil changes are certified mechanics. We know what we are doing and this customer is upset because she needs a motor. we understand her frustration, and would work with her on a payment plan as we have done for many other satisfied customer because of the hard economic times. We understand the difficulties of not being able to work without transportation and always try to help assist our customers with whatever we can; whether that is with a payment plan, a rental car, or a lower price than advertised."
