Statement of Claim
Claimant says:
"Here is the letter i sent to the owner of the company. by certified letter. still no response!
bait and switch. on the copy of the receipt also states that i asked for the up to date CD for my navigation system. Something did not look right there were streets missing, so i contacted General motors they said the CD they sent was 2 years old not the newest one that i asked for. i called the company and some guy i talked to said all CD do not have all the streets on them. I told him so you did not send the newest, i told him one 2013 might have some streets missing but it would be better than one two years old! note: i am disabled and have to account for every penny it took me four months to save this much so i could get the updated navigation disc. then they do a bate and switch on me that is two years old.

I recently purchased a navigation disc from your company. Before I even purchased the disk I asked you if this DVD was up to date for my vehicle, and your response was that it was. My question I asked was even on my receipt. Something was just naught right so I contacted General Motors and asked them. They intern told me it was an old DVD. I intern contacted you again, and then you tell me there is one updated for 2013. At two times the money I paid. I feel that I was taken advantage of. And you mislead me. Unfortunately, it has fallen far short of my expectations. When I attempted to use it, there are streets that are not showing up. After making my purchase I tried to put in an address no such address. I had to use MapQuest in order to get directions. You said there might be streets missing on the 2013. But it would be better than a two year old disk.

I am appalled at the substandard quality of this product, and being mislead I will be returning it to you when I get the correct one. I expect the newer DVD at you cost within two weeks. I paid $148.88 for it at your company AudioVideo2go. If you have any questions, you can reach me at 972-412-7207.

I hope that I will not be forced to report this incident to the Better Business Bureau and state and federal consumer agencies, as well as popular consumer advocacy blogs. If i do not get a response.

I CALLED BACK THEN THEY SAID THEY NEEDED AN ADDITIONAL 150.00 TO GET THE UP DATED DISC. THAT'S WHY I SAY BAIT AND SWITCH. WHEN I FIRST CONTACTED THEN THE SHOULD HAVE SAID THE 1013 DISC IS 250.00 RATHER THAN SELLING ME THE 2011 ONE THEY SENT ONE TWO YEARS OLD. IT'S JUST NOT RIGHT..ABOVE STATES The customer agreed to the terms and conditions of purchase which are also stated in the description: WHEN I WAS TOLD IT WAS THE UPDATED ONE YES I AGREE BUT THEY SHOULD NOT HAVE SENT ONE TWO YEARS OLD. THEY DID NOT SENT THE MOST UP DATED ONE... THAT THE HOLE POINT THEY SENT ONE TWO YEARS OLDER!

    The second sentence of the product description is: This is the original disc that came in 2011 vehicles and will update your car to 2011 maps.

    Again in the details the part number is given and the year release is repeated: Released 2011 Update

    The copyright dates are also given: 2010 Denso Corporation

    The customer agreed to the terms and conditions of purchase which are also stated in the description: Returns are not accepted on navigation discs (a standard practice for software and media). Please be doubly sure you need this disc before purchasing.

    This seems like a case of buyers remorse. We offered Barry the choice to upgrade to the newest disc but he chose to harass our accountant (who he thinks is the owner of the company) at their home and continues to harass and threaten us with litigation and prosecution.

    Due to these threats we strongly believe that Mr. Guindon is trying to take the path of extortion instead of reason. We kindly request that you no longer contact us regarding this issue - your case has been closed. "
