Claimant's opinion: California courts have found diminished value does exist, and that only 3rd party claimants are able to collect on it. Insurance companies are making millions by denying valid claims and using their size and wealth to bully consumers.
Claimant's opinion: If an insurance company is going to have me jump through all of these hoops to file a diminished value claim, why would they then deny that claim citing "California law" as their basis for denying the claim? Why wouldn't have Jovanna just told me in the first phone call that Allstate doesn't pay diminished value claims. Instead, she gave me a list of items to collect and send to her for review.
Claim# 2922781401. Diminished value exists. Certain states make carriers pay 1st party claimants. Georgia state law requires insurers to pay DV to 3rd party claimants. The reason I mention these is because your adjuster tried to act as if diminished value was something I just came up with out of the blue. 2. The adjustor told me to get a list of evidence supporting my claim, then turns around and sends me a letter saying California law does not require carriers to pay both dv and repairs. If she knew that when I first called to inquire, why wouldn't she save me the hassle of collecting all the information? And how come when I asked her to provide me with the specific California law which relieves Allstate of their liability she put me on hold for 10 minutes and then came back on and said there IS no specific law? I then asked how she can be justified denying my claim and she hung up on me!! Her letters were written under false pretense with blatantly vague and deceptive wording. 3. The fact that Allstate considers it fair to repair my car and tell me I got what was owed to me is ludicrous. I wasn't owed a 4500 loss in value in my car, lost money from time off work, the hassle of this entire process, and especially not the attitude of the adjustor.4. I've spoken with lawyers, a former Allstate adjustor, the Insurance Commission, and read countless claims online. I have facts on my side. When pressed to provide proof that Allstate isn't liable, I was repeatedly given an answer based on a law she can't cite. 5. The letters denying my claim kept using the phrase perceived diminished value. There is no such thing as perceived diminished value. I am basing my claim on INHERENT diminished value. I can't sell my car back to a Nissan dealership because my factory warranty can't transfer due to the frame damage and after market parts. They won't pay more than rock bottom because it's going to auction or another dealership who can sell it without warranty for pennies on the dollar.6. In my phone conversation with William Jeffs he mentioned that the accident wasn't reported to Carfax yet. I knew that he mentioned this in order to convince me to not disclose the accident history at time of sale in order to sell it for more money, so I made it clear that dishonesty and non-disclosure is not something I am willing to be a party to. The fact that it would even be suggested should be criminal.Feel free to contact me with any further comments or concerns before this complaint is made public and sent to the various reporting and government agencies.
