Statement of Claim
Claimant says:
"LAST AUGUST I BOUGHT A HANDICAP VAN FROM ACCESS. UPON DELIVERY CHRIS ADDED 2.000 DOLLARS ONTO THE PRICE OF THE VAN TO FIX THE POWER SLIDING DOOR AND WHEEL CHAIR RAMP TO WORK PROPERLY. WHEN PARTS CAME IN I TOOK THE VAN BACK TO BE FIXED THREE DIFFERENT TIMES AND DIDN'T HAVE MUCH LUCK. SHORTLY AFTER THAT WHEN I CALLED HE WAS ALWAYS AVOIDING MY PHONE CALLS OR SO-CALLED WITH A CLIENT. I CALLED COUNTLESS TIMES AND LEFT MY NUMBER FOR HIM TO CALL BACK AND NEVER RECEIVED A CALL! I WOULD THINK WERE HE IS A LICENSED DEALER THERE WOULD BE A PROTOCOL THAT HAD TO BE FOLLOWED OR SAY A CHECK LIST FROM OPERATING PROCEDURES. NONE OF THIS WAS CHECKED OUT. I BOUGHT THE VAN AS IS BUT PAID 2,000 DOLLARS EXTRA FOR THE DOOR AND RAMP THAT WAS NEVER FIXED PROPERLY. FOR THE PAST EIGHT MONTHS I'VE HAD TO HAVE SOMEBODY WITH ME TO GET IN AND OUT OF THE VAN!!!! IF YOU PROMISE TO DO SOMETHING THEN DO IT, ESPECIALLY WHEN YOU ARE PAID TO DO IT!!!!!!"

  • As with all things in life there are two sides to every story. At the time Mr. Mooso had been recently discharged from the hospital and in a huge hurry to get a van and like most of us wanted to spend the least amount possible. In an effort to do a good deed Access Vans offered Mr. Mooso a newly traded 2003 Chevrolet Venture Van with an El Dorado Wheelchair Conversion with 121,988 miles at our cost. The agreement was that this was an AS IS van. Everything on the van was operational at the time of delivery.

    In an effort to go above and beyond Access Vans looked at the wheelchair conversion on multiple occasions in order to fix problems as they arose for several months after the purchase at NO COST to Mr. Mooso. Six months after the sale Access Vans purchased a new computer control module for $300 at NO Cost to Mr. Mooso.

    In doing research we discovered that we added the purchase agreement incorrectly in Mr. Mooso's favor by $1184. There is no basis for Mr. Mooso's claim that he paid an additional $2000 for door and ramp parts.

    The $2000 added to the price of the van was for a Wheelchair Lock Down Device and Hand Controls.

    Our only failure was to not fully express to Mr. Mooso that his business was not wanted. We felt he was being unreasonable in his demands.

    Please look at the attached files to show that the purchase agreement was indeed miscalculated, the AS IS form he signed at time of purchase, and the Idaho Department of Vehicles application for title. This documents clearly show there was no warranty of any kind on the 2003 Chevrolet Venture or the Eldorado Wheelchair Conversion.

    If Mr. Mooso is unhappy with his 9 year old van he should consider purchasing a newer van.
