Statement of Claim
Claimant says:
"My husband and a friend rented a 4wheel drive vehicle so we could go 4 wheeling in the mountains above Silverton.We picked up the vehicle and were told that we could take the side windows off but not the back top.So we did that and put the sizzper windows in the back between the back sest and the rear of the vehicle. Had a great trip .Returned the vehicle at 5 that evening and signed a check in listed that everything was ok, and so did the employee .All was fine until about 2hrs.and rental company calls us to tell us we scratched the windows and they were going to charge us $200.to our credit charge and if we disputed it that they were going to put a claim on our insurance for $ 460.or more for a band new top for the vehicle . This is wrong and when we wanted a copy of the check in paper they wouldn't let us have it and so the Sheriff was able to get it for us ...They were very hateful and so now they may take us to small claims for we refuse to pay for something we didn't destroy.I have taken picture of the car and the sheriff looked at it and said he could'nt see any damge but it was a civil suit and he was could only be a 3 person in the matter.This is wrong and makes me wonder if they didn't do the same to the other 4 people who rented the vehicle before us and if the scratch on the pastic window came from them? We didn't take pitcures before we rented it and didn't think something like this would ever come about. We are seniors retired people and respect other people's property and we paid for the hours we used and also insurance.Let me know what can be done about this. They are wrongfully accusing us and want us to pay for something we did not do and I refuse to let this go unknowest."

  • It is very troubling that after so much time, thought and consideration that was put into this fiasco, days later I am sitting here. Being a family owned business we pride ourselves with great service, a personal touch and seeing our regulars multiple times a year. In eight years of business we have never had to call the local sheriff to help with a disgruntle customer, the day after it was settled with the spouse agreeing to take care of damages. The top in question had been out only four times prior to this rental. Two of those rentals the windows in question were left at office. Unfortunately the top comes only as one piece, at the cost of 469.95 plus tax, shipping and handling. Trying to work with our customers we met them at $200, leaving us over $300, to bring back the vehicle to a "as new" condition, as agreed and signed in our contract (section 5 clause c). Why one spouse agreed and gave us a card to charge and the next day the other came in, only to be removed by our sheriff demanding private business paper work. I am saddened to hear that after doing all we did to meet them in the middle so much trouble could come of it.
