Statement of Claim
Claimant says:
"My Surgeon ordered a tens unit for me from Zynex Medical after my neck surgery. I received the tens unit with 2 batteries and electrode pads in May or June 2015. In June 2015 I received 4 additional batteries and four more packages of electrodes. In July I received the same number of addition supplies. I called Zynex as to why I kept receiving additional supplies that I did't need. The said that they had put me on an automatic shipment schedule. I told them that I did not approve or authorize them to do that. I told them to immediately take me off the automatic shipments. I told them that I was going to return these additional supplies to them since I did not need them and had not even authorized them to be sent. They told me I could not return them since they were considered to be disposable. In September the postman tried more supplies that I assumed were more batteries and electrodes after I had told Zynex not to send me any more. Zynes sent me a bill for $163.00 for the tens unit and supplies. After I determined that my insurance would not cover the tens unit or supplies I packaged them up (including the tens unit) and sent Zynex a letter stating I wanted them to clear my balance with them. I had not used the tens unit or any supplies ( all of the supplies were in sealed plastic packages). I also mentioned in that letter that the postman had attempted to deliver the above mentioned 3rd shipment of supplies but I immediately wrote "Return to sender" and told him to return them to Zynex. I never took delivery of them. A short while later Zynex sent me a second bill this time indicating I owed them for the supplies I never took delivery which as it turns out were 4 more batteries and electrodes. Since I never authorized them to set me up on automatic shipments of 12 batteries and 12 sets of four electrode packets was absurdly excessive in a matter of only 3 months, I want to file a formal complaint and request that pressure be placed on Zynex to zero my balance with them. I was told by my doctor's office other patients have complained of being told they have to pay for the unauthorized shipments of supplies as well. This practice appears to be fraud or something close to it anyway. Please contact Zynex and put pressure on them to zero my balance with them. Please let me know the outcome. My e-mail address in koabyron@yahoo.com and phone number is (559) 625-5694. Thank you."

  • Do you have medical insurance or Medicare/Medicaid? There is a huge amount of what is basically fraud in the medical supply industry - shipping unnecessary supplies. We had a terrible time stopping automatic shipments that the company implied were both covered by our insurance and necessary. They weren't.

Who told you the unit would be covered by insurance? Did Zynex tell you that?
